    Hello,
    Thank you for your answer to my previous query. Our solicitors have also submitted an AP1 in respect of title number NT530125 that the Land Registry registers the burden of the relevant right of way. Could you tell me the steps that are required to be undertaken by LR and the expected timescales please? Our solicitors have provided evidence that show property transfer dates, and the relevant clauses within the transfers that we have right of way over a piece of land which was incorrectly transferred a year after our purchase. As the land was mistakenly transferred, the right of way is not currently detailed on the title plan. I believe a request has been made to expedite this, as it risks causing the whole chain to collapse if not resolved quickly. Are you able to check if this has been expedited or not please?

    The application was submitted 4th May and expedited 14th May. Unfortunately there are a few prior applications against the other affected title which have priority so that will delay matters I’m afraid. 
    If the applicant affecting the other title does not reply before next week then their application is likely to be cancelled. If that happens then your application will be considered ASAP. 
    Hello, thank you for the information. Does that mean the applications cannot run in parallel, one has to complete before the next one starts? Are the few mentioned applications all related, so either all cancelled or all progressed? Thanks
    Whilst they can it’s rarely the case as each has its own priority over the other. The oldest one cannot complete as we need more from the applicant. We can’t jump forward until that’s resolved 
    Cancellation of an older application does not result in cancellation of later ones unless they are dependent of course, which they are not 
    Hello, thanks for the explanation, I appreciate the update. Has the oldest outstanding case been started or is it still awaiting to be assigned a caseworker? 
    The oldest one has been processed but we need more from the conveyancer and they’ve yet to respond 
    Thanks. How long do they have to respond? Is there a set timescale on these things considering a case that it is holding up has been requested to be expedited?
    Set timescales as in 4 weeks with a reminder at 3 weeks. They can ask for an extension though so it’s not a ‘short’ timescale 
    Are you allowed to tell me when they were first contacted? How many weeks or days have already passed?
    I’m not sure it’ll help you as there are another two applications after that one in play as well before yours although the conveyancer involved is the same as your one it seems so presumably aware

    I think you mean that they all bought their freeholds. If they did then some may have determined their lease by merging it with th3 freehold. They then have just a freehold property/title. 
    If they didn’t merge then they’ll still have a freehold and leasehold but both in same name(s). 
    If you paid a cheque then where’s the transfer? If you don’t have a transfer then it’s still owned by the seller presumably. 
    And what’s registered? Both freehold and leasehold or just the latter? 
    I and a lot of my neighbours, took this offer to buy their own freehold. This was done for a fixed price for each property. My buyers solicitor on the records they have done searches for and sent to me   from yourselves . There is no details of freehold change. Yet there is details of my wife name being added in 2018. I only have a cheque payment stub with details of solicitor and amount paid to them in 1986. Which was about same time of offer for buying leasehold. My bank does not have details that far back. Is there a different record that the leasehold / freehold change may be on ? 
    No hence if you bought the freehold you’d need a legal deed (transfer) which would then need to be registered 
    I am not sure if you can answer this. Just after the cheque was paid for freehold. There are no further payments to the leasehold company. Who if anyone can I contact to find out why my leasehold / freehold was not changed. I would of thought that even though leasehold was small amount, letters would be sent for non payment ?
    Find out why? - ask whoever was supposed to complete the transaction for you
    If that’s not possible then you’d start with whoever still owns it 
    Thanks for your help. After a lot of checking. I have been now notified that someone at buyers solicitors had not read the deeds correctly. Wording on there confirms I own house and freehold.

    That’s how it normally plays out. But there’s little point stressing at this stage as it’s not within your control. Hold fire a little longer and you can deal with the facts hopefully rather than uncertainty which is what you have currently
