That’s a RX3 application submitted on 16th March - wait time before it’s likely to be considered 5/6 weeks but could be longer
If it’s urgent then ask your conveyancer to request expedition

    Hello,

My property purchase completed on 17/12/20, but I’ve not heard from my solicitors regarding the transfer. Could you please check the current status?

    Thank you.

We have 3 applications now to register the transfer and remove/discharge other interests. So hopefully all the pieces needed are now in place and things should move forward ASAP now. It’s with a caseworker so hopefully a few days wait IF all in order.

  • Hi
Is it possible to have an update on expected timescales for our case?  Part of the property boundary is incorrect, I understand our case was expediated due to impending sale.  An Ordnance Survey surveyor visited the property yesterday - however no one is able to tell us how long this is expected to take.
HM Land Registry Reference : XA3BC1C
    Title Number : LAN244764
    Many thanks.

    Hello,

Hopefully this is the right forum for this question. I've downloaded the title register for a freehold house we've made an offer on. It's an ex-local authority house.

Under the charges register it says the following:
"This register contains any charges and other matters that affect the land.
1 (23.09.2004) A Transfer of the land in this title dated 9 August 2004 made between [the local authority] and [the first buyer] contains restrictive covenants. NOTE: Copy filed.

It doesn't specify a reference number or anything further. How can I go about ordering a copy of this transfer to see the restrictive covenants?

    The title number is AGL133316.

    Thank you.

The simple answer is that it will be processed ASAP but I’d expect a few weeks wait yet, at least. Why? Well your example is a quite common one re urgency/speed as it’s an application to register for the first time re a claimed ownership of unregistered land.
There are 3 key stages re such applications
    1. Consideration if the statement of truth and supporting evidence - is that enough to satisfy the registration/legal requirements.
    2. Site visit/survey - only happens if stage 1 passed. OS do the survey - 2 weeks wait but can be sooner. They then report back on findings.
    3. Wider checks - if the survey report backs up the claim we will invariably contact adjoining land/property owners to see if any object/consent. Those checks take time to complete normally, minimum 3/4 weeks.
So IF the survey was done yesterday I’d say you are looking at a minimum of 4/5 weeks still. But it could be longer depending on report/checks. So too soon to be definitive other than it’s not going to be 1/2 weeks wait still.
The application has been expedited, so there’s an urgency involved, but expedition simply reduces the wait time at the very start from receipt to wait time. It does help re wait times between report in and checks started too but it doesn’t hurry up OS and/or anyone we contact re wider checks
A conveyancer familiar with such applications/claims should have a feel for the above but most I suspect would not commit to any defined timescales until at least stage 3 when they’d have a better idea as Stages 1 and 2 have been reached

Thank you - is it the deeds we're after if we're looking for the restrictive covenants?

You were asking after the specific deed referred to as ‘filed’ - that’s what you would apply for using the linked form OC2
You can’t apply for just deeds for example as we don’t hold them. The linked guidance explains
