    If I could briefly refer back to our conversation earlier this year (April,2020) re: transferring part of my uncle’s property on his death (TIC 50% him, 50% his wife)  to his two adult children (25% each):

    Our conversation started at 7:41 on 17th April (page 215) and concluded on 19th April, at 12:57pm (page 217) on the same forum.

     As discussed at the time, I sought legal advice who confirmed that my aunt can transfer the property from herself (as sole surviving legal owner), to herself plus the two children using forms TR1 and AP1, without needing to apply for probate.

    It’s taken me some time (given the national situation) to prepare the forms for my aunt as detailed above, but I’ve now done so at last following guidance notes on LR website as best as I can. I was wondering if it is possible for the LR rep to take a look at these before I (eventually) send these forms on to my aunt to complete?

    We don’t pre-approve I’m afraid and the notes on both the form and website should be enough to help with their completion. 
    If you’ve got a specific concern re a panel on a form then we can sometimes help but it should be covered by the notes as mentioned. 
    If it’s not then it reads as if it’s stretching beyond the advice we can offer 
    But I’m sure other posters will be happy to comment/help if needed

  • Bit of advice needed as a FTB here, if this is normal issue you can run into regarding buying a new build house. I'll try to explain it as best I can.
    A plot of land was purchased by developers in 2017 and six new houses were built in 2019. Three out of the six new houses were purchased directly from the developer, by a property investment company, and the remaining three houses purchased by individuals, directly from the developer.
    Of the three purchased by the property investment company, two are currently being rented out and the third is the property my partner and I are trying to purchase.
    On the LR website five out of the six houses are showing the initial purchase of the land by the developers in 2017 (assuming this is what is called the first registration of a shared title?). One out of the six houses (we will call plot number 2 for this example) shows no information (No property description available).
    Long story short, the purchase of the house we want to buy apparently cannot proceed until the first registration of plot number 2 is completed. This is entirely in the hands of the lodging solicitor for the purchaser of plot 2, and so far they don't seem to be providing LR with the required information.
    If we were buying a property directly from the developers, I don't believe we would be experiencing this issue.
    Is this normal with new estates where one plot/property registration can hold up/impact the others?

    I wouldn’t say it’s normal but it’s certainly possible. The devil will be in the detail 
    There’s no first registration involved so it reads as if you need to get to the bottom of what the specific hold up is with the seller/conveyancer involved

    I thought I would receive some sort of documentation that the freehold had been transferred to me.  All i have is a letter from my solicitor.  How do i check the Freehold is now mine

    Ask the solicitor to confirm it’s been registered and to give you a copy. 
    If it has been done then you can check online for £3 but don’t unless you know it’s been completed

  • Hi, a question about first registration at Land Registry and who can expedite. 

    In October 2020, I had an offer accepted on a house, with no chain. The property is unregistered and the intention was always that my solicitor would register the property post completion. However the seller's solicitor notified my solicitor that there were some challenges with pulling the documentation together to evidence epitome of title. On this basis the sellers’ solicitor applied for registration via Land registry in early December 2020. The seller’s solicitor has not gotten back to me with any further information or any update on the application (they have been very unresponsive throughout this whole process). 

    Since the registration is holding up the purchase of the property, I presume a request for the application to be expedited can be made. Is there any way of finding out whether this has been done? And if the seller's solicitor has not expedited it, can I/ my solicitor request for it to be expedited? 

    Also what are the current timeframes for registration? @Land_Registry

    Your solicitor should be able to check online using their secure portal. That will also tell them if it’s been expedited. 
    If the seller’s solicitor has not expedited it then your solicitor can submit a request and documentary evidence to confirm the sale/purchase. 
    I would recommend you ask your solicitor to check/confirm and get the other solicitor to make the request or explain why they won’t/can’t 
    Without expedition it’s likely to be a 6+ months wait.
