  • Hi Land Registry.
    The sale of my flat is being held up as the Deed of Variation scanned in by the Land Registry is too pale and doesn't not clearly show the coloured areas. (Personally I think you can see them but my buyer's solicitor thinks otherwise). The deed was issued in 2016. Are you likely to hold a clearer copy?

    I'm afraid not. Whilst we note such variations and file a copy the landlord and tenant are responsible for holding the original/copy as appropriate.
    If they won;t accept it then you'll need to discuss options with your conveyancer

    Form AP1 is an application form
    Form ID1 is used to verify a person;s identity
    Form AS1 is a legal deed used for example by an executor to transfer the ownership of a deceased's property to the beneficiaries
    So if the property is owned by the deceased, your are their executor and your sons are the beneficiaries then yes forms AP1, AS1 and ID1 for the two sons would be needed
    If they are not actual beneficiaries then you still need AP1 and ID1 but it would be a form TR1 needed to transfer

    My partner wants to sell me their half of the property we jointly own (commercial property) . As I understand it, they would have to fill in a TR1, and AP1, but would we both also have to get an ID1 completed with it being our names on the deeds? (No mortgage involved).

    Also, how long does the process usually take?

    JJA80. I’m pleased to tell you that another house in the sheltered housing complex I wanted to live in became available in July. Although I couldn’t exchange by the time my buyer’s buyer wanted to complete on my buyer’s house, 23rd August, I decided to risk selling my house to my patient buyers, put my contents into storage and move in with my son until I could exchange and complete on the new purchase. This was finally achieved on 30th November and I’m now happily settled in.

    If the Land Registry has accepted a plan, is it fair to say that they think the plan is of an acceptable quality?

    I am having issues with my buyer's solicitor who thinks your version isn't clear enough, when it was fine for my own solicitor, freeholder and mortgage lender.
  • When a person takes over a Freehold and registers with the Land Registry what proof of ID do they need to give to say they purchased the freehold? Does the previous freeholder need to send info to the Land Registry to say that they have sold the freehold? I would like to know if procedures have change since 1997.

    Yes re both IDs. Average timescale re wait from receipt to being considered is 2 weeks.
    We also make a series of wider checks and these can take up to 3 weeks to complete.
    So you are looking at a 5-6 week timescale on average

    If we accepted a plan then it must have satisfied our requirements at the time. I suspect that if it’s faded over time then it was a paper plan which then aged. It’s been scanned several years later so it’s the ageing/fading that’s created the uncertainty for the solicitor

    So very much up to them now re acceptance and how they view the risk. The fact we accepted it way back when in its original quality is probably irrelevant now in the context they are rejecting it
