    I have chased previously as have my solicitor and was advised it would be looked at this week by the lawyers but we have heard nothing yet. As previously discussed I am waiting to complete and this is holding up the sale so is extremely urgent and stressful. Is there an update? Title number ST277197.

  • Hi Land Registry,

    We are in the process of buying a property (ground and first floor) and have come to an agreement with the freeholder where the lease plan/land registry plan will be rectified to show a section of the garden belonging to the basement flat (to reflect the garden as it currently is used), and the leasehold we are buying will be updated to include the loft.

    What is the process of doing this? Is it two separate requests to the land registry i.e. one to alter the garden plan and one to include the loft in the lease?

    Assuming the seller and the freeholder agree to this happening, what is the likely timescale?

    If the rectified garden and loft are being added to the same lease then that is often done by way of a single deed of variation
    That will act as a surrender and regrant of the original lease

    There's a backlog of that type of work at present so of it's urgent whoever applies needs to include documentary evidence of the onward sale being confirmed and time sensitive and ask us to expedite the registration. Expedition reduces the wait time to a few weeks providing everything is in order

    When I spoke to LR yesterday they said they was waiting for the ordinance report back and told us to contact who did the survey, we don’t have the details of that person or company, do you know how we can find it. We’ve only got 3 weeks to sort this or our chain will collapse so I’m panicking. I had to create a new log in for here, it’s still me.

    Many thanks - as advised by us over the phone a survey/site visit was required and this was completed on the 22nd.
    We are waiting for Ordnance Survey to provide that report but I suspect there has been a delay in doing so due to bank holiday weekend
    We should not suggest that you contact OS direct so apologies if that was the advice given
    The case record shows multiple contact chases by the solicitors involved as well as individuals within the chain.
    The application will be dealt with expeditiously at each stage but until we get that report back from OS we can't see what stages are needed next.
    I'll post again when I have some more info to share but if you prefer to ring us or get your solicitor to do so then that is probably the best way of doing it - multiple enquiries don't always help as you can get a mix of Qs being asked and therefore a variety of answers which can add to stress/panic.
    Far better to manage the parts you can control but I do appreciate that with so many pressure points in the process at present it can be hard to not panic

    I checked earlier and not with us as yet. If it is not with us by the end of the week then we will make some wider enquiries.
    But forming the report and updating the OS detail is not a super-quick process so we are in their hands re completing that part of the process
