    Land Registry don't record the exact location of a boundary, they work under the general boundaries rule (section 60, land registration act 2002).
    LR would not be able to offer any legal advice as to how to proceed regarding the boundary but Practice Guide 40 supplement 3 describes your scenario and possible solutions. (PG40 s3 link)

    I would definitely recommend legal advice if you can't come to an amicable solution between yourselves.

    My leasehold flat purchase completes early next week. Cash, no mortgage.

    How long is the wait until it appears online on the LR title.

    As you suggest it's not a Q for us as these specific boundary issues are generally only resolved between neighbours. And tend to escalate into disputes if agreements are not made.

    Definitely legal advice you need here re options and things to consider and then some form of discussion with the neighbour as appropriate. Important in that order so you know what to say or do to try and achieve the outcome you.

    The registered information is highly unlikely to define anything in any detail for you. And what was needed in the 1930s has radically changed so attitudes have changed too.

    Your local planning authority website will advise on height if structures permitted without their permission. But again in my experience that isn't the only thing to consider here as you gave your neighbour's reaction which may just escalate the issue further.

    Best advice is to confirm your legal understanding and then share that, your own views, information and understanding with your neighbour and agree a way forward. Rely on the facts and add to them as a combined result and hope it works out for you.

    I'm afraid not as it's still waiting to be considered as the backlog still affects.
    Late July was based on average timescales only but it's still with us

  • Hello, we are in the process of buying a house in Staffordshire and our solicitors have said that the only thing we are waiting on is the land registry to go through for the vendors sale a few months ago. (Help to buy scheme in a new build).

    We know that Land Registry have requested to go out to the property and check that the plans match up because of an odd shaped path, but does this mean that we will go back to the 'bottom of the pile' or should our case be dealt with pretty quickly from here? The initial request was submitted in April, and we have been living in boxes in a small housing association flat with two small children since may.

    Our contract is signed and it is this alone that is holding up completion.

    If the site visit is directly linked to your application then no re bottom of the pile. If it's linked to the wider development then your aopplication is probably in the pile but not at the bottom.

    The seller's solicitor should be able to confirm progress/ situation for you. Have they asked for it to be expedited?

    It's not a merger but an application to upgrade the first title from a qualified leasehold title to an absolute one. It has been referred to one of our lawyers for consideration and the seller's solicitor is aware.

    Hopefully it will be considered shortly and next steps taken towards completing it. I'll flag with processing office also

    An application was submitted last Friday so now needs to be considered. That should happen within the next 5-10 working days

    Two things to stress here are that
    1) the nature of the application means that it will need to be considered by one of our lawyers as you are trying to rectify something registered in 2009 and
    2) It is quite possible, if the details provided are seen as being sufficient. that we will need to carry out wider checks including contacting the current freeholder as well

    However I mention those merely based on general experience so until it is considered we don't know what is needed, inc wider checks.
