Just to make it more complicated. If the person that has supposedly made the verbal agreement, has since died. Does this make any difference. The land wouldn't need to be changed at all when claiming it back. Basically it's like a car parking space that is showing up on the title plan to the house I would like to buy.

It's how the law woukd view it that counts as any verbal agreement may die along with it's giver so to speak. But not something we can advise you on. This us what your conveyancer should be considering whilst explaining the options/risks involved“Official Company Representative

Hi, we could do with some help if possible. We are currently having major delays on a property we are purchasing as there was a restriction placed on the land registry by the developer when the house was built in 2015. The restriction should have been removed when the current owners purchase the property originally but this was not done and now we are having to wait for the restriction to be removed before we can complete. The vendors have contacted the original solicitors who acted for them in 2015 who have applied for the restriction to be removed which should be pretty straight forward but now we are waiting for this to take place before completion can occur. Is there any way in which we can complete pending the restriction being removed, and if not what is the usual turnaround time for this to be removed?
Is there anyway we can speed things along?

The timing if when you complete is only something you can agree with your conveyancer. Most will want to wait.
Average timescale is 9 working days between receipt and consideration. Everything then depends on it being in order and/or whether wider checks are required e.g. inc contacting restrictioner. If we do the latter then that can't be 'rushed' as they have time to respond. Your conveyancer should be able to tell you date of submission and current status“Official Company Representative

The PG states SDLT will probably be payable but that's in the context of property exchanges.

The solicitor can track their application and advise you on timings
If you have lenders consent and a deed signed from neighbour to have the ROW removed what other problems can occur or stop it from being removed
