    Hopefully none if all the affected landowners/lenders are all in agreement. Problems only tend to arise if errors have been made in the wording/execution of any deed or consent

    As a trustee (tenant in common) of a property i have Form K restriction against my beneficial interest in the property which I in turn hold on trust for other beneficiaries before the restriction was placed.

    As such I hold no beneficial interest in the property. As there is no conveyance of title how do I get the Form K restrictions removed from the property?

    See section 3.7 of our Practice Guide 19 on how to apply to cancel a restriction

    The key to such an application is the supporting evidence/facts and how that impacts here as you are registered as a joint legal owner but are holding it on trust fro a beneficial owner.

    We can't advise you on such matters and I would recommend that you seek legal advice on both the interest the form K protects and/or the legal/beneficial ownership aspects

    I am told that all required paperwork was directly submitted last week. My solicitor has not received an update though. Are you able to check that this has been received?

    My friend is considering putting her house in trust so that her daughters do not inherit... however she would have a parcel of land worth about 70k which I believe would be subject to probate therefore allowing her children to make a claim ... if she sold half her interest in the land to someone else therefore jointly owning the land, if she passes away would the land form part of her estate or go to the person she jointly owned it with ... this person would not be a relative or partner?? Any advice greatly appreciated 😊

    Best not to post a question across multiple boards, the thread you have started thin the deaths, funerals and probate board is probable where you will get the best responses.
