  • Hi, I'm late on in the process of selling my house, I've just paid to have a restriction on the land registry for my property removed, how can I find out if its been done yet? Can I go onto the land registry site myself and have a look?

    You can but it'll cost you £3 and if it's not been done yet then it's money wasted.
    I'd ask the person you paid to confirm or at least ask them how and when as timescales can vary whether it was an RX3 or RX4 form used. Happy to take a look if you have the title number though?

    I'm sorry to read of your recent loss.

    It's really legal advice you need hear to discuss/decide on what is best for your Mum and you and your sister. We register the outcome of such advice so cannot really offer any specific guidance as to whether you need to do anything or not.

    It may help though to explain a few things around the ownership as the legal ownership of the property has now passed to your Mum. The legal ownership only ever transfers as a whole as it is the land/building so can't be split

    Your late Dad's 'share' is in the beneficial ownership. Their beneficial ownerships can be split as in basic terms that relates to the value of the land/building. As that's in £s and pence you can split that 50/50

    IF you decide to transfer the legal ownership from Mum to say the three of you then that would trigger the need for it to be registered for the first time.

    However if you decide not to transfer it then it can remain unregistered. Much may depend on how the beneficial ownership is split e.g. wills, trust deed or other and/or whether you and your sister own another property etc. But all of this should be considered with a legal/financial adviser before doing anything else.

    If your decision triggers the need to register the property for the first time then that's when we get involved in advice on how to do that.

    I would like to swap some land along the boundary of my property with my neighbour on the other side. We would exchange an equal area of land, about 4.5 square metres. As far as I can see we would both need to complete a form TP1 but I am wondering if there might be any ramifications that I am not considering. My property would acquire some road frontage as a result of the swap, something that it does not have at present.
