    LR I've just tried, for some reason i was unable to edit the post, I'll try again and contact admin to get it removed.

    The reply recieved no one suggested that evidence needed to be supplied I am sure if they had of done we would do, it was just flat out denied.

    Will email the above directly.

    Thank you for your help, the situation has drawn out for so long now it would be a relief on so many parts to get it sorted.

    Hello,

    We are so close to completing on our purchase, however the Title Plan showing the property boundaries is wrong and needs correcting. What impact will this have and how long will it take to resolve?

    Title Plan DU105811 (the red border to the right should be on top of the grey border).

    JJA80. Thank you for clarifying the present progress on my application for AP and confirming the issue is being sorted out by Land Registry and KCC as quickly as possible. According to the plan supplied by KCC their objection only relates to a tiny triangle of the existing verge. I make no claim for title to verge, just that I retain the historic long standing legal right of access across it. As long as that is retained I have no need to own it.
    Thank you for continuing to monitor my application for further progress, I await your next update.
    I have just received an email from KCC advising me that they have today, 23 May, sent you an email. They gave me your email address and suggested I ask you to send me a copy of their reply to you. Your reference is S232TTQ. I emailed you as suggested and your receipt ref. No is 190523 - 002981.
    I have now received a phone call from KCC confirming they have withdrawn their objection so can I hope that my application can now be formally approved?

    It all depends on what the correction is and who has to be contacted, for example another registered owner.

    However I don't understand the the reference to 'the red border to the right should be on top of the grey border' - we don't use a grey border?

    We had an AP1 with "land edged in red" and a black and white plan, asked for a colour plan.
    The AP1 came back amended to read "edged in dark black" and a note saying "please ignore the light black edging, we didn't put that on there."
    I wonder what's the difference between dark black and normal black! :think:
    The light black (small piece of waste ground) was definitely grey, but yes, not a colour LR use. :)

    I am in a similar situation to Camkite, submitted a lease extension at the start of Feb and it is still being processed. The allocated Title Number is PM34904, could you advise on the current timescales for this to be completed.


    As I have a sale in process (with a Buyer who is getting nervous and may potentially withdraw their offer) what evidence would be needed, and where does this need to be submitted to, to expedite it if a completion isn't on the horizon?

    In the current scheme of things I doubt if this will be considered for some weeks yet.

    So your solicitor should submit documentary evidence of the confirmed sale/purchase and ask us to consider expediting it. They should be aware of the process for doing that.

    If they do that and we can expedite it then the wait time is reduced to around 10 working days. Everything then hinges on it being in order

    Reading some earlier posts, as charging orders placed in B restrictions are not registered charges against a property, can a county court rely upon such charging order restrictions to support an Order for Sale under s90 of the Law of Property Act 1925? when effectively the creditors are only volunteers

    See section 4 of our Practice Guide on Transfers under power of sale

    I think the distinction you are making though relates to a CO against one of joint proprietors where it can only be registered as a form K restriction in the B Proprietorship register. If so then it's effect is limited - see section 4 of our Practice Guide on charging orders and the accompanying algorithms
