JJA80. Sorry to bother you again. Highways have just confirmed that they did contact you on 15 May and will be contacting you again today. I know it’s only a few days and you are monitoring the application but could you check if Highways’ response is now shown on my application?

Sadly I've been told that as delays at the LR office are so stacked up its not been possible to expidite an application.
Almost 5 months since the application was submitted one really does hope that it can't be that much longer regardless.

[FONT="]I'm in the process of buying a house that has 3 restrictions on the title deeds. Does anyone know on average how long it takes for the RX4 process to take with the Land Registry?[/FONT]

[FONT="]RESTRICTION[/FONT][FONT="]: No disposition of the registered estate, other than a disposition by the proprietor of any registered charge registered before the entry of this restriction, is to be registered without a certificate signed by the applicant for registration or their conveyancer that written notice of the disposition was given to *********** (the trustee in bankruptcy of *********) at ***********[/FONT]
[FONT="]RESTRICTION[/FONT][FONT="]: No disposition of the registered estate, other than a disposition by the proprietor of any registered charge registered before the entry of this restriction, is to be registered without a certificate signed by the applicant for registration or their conveyancer that written notice of the disposition was given to ******** and ******** (joint trustees in Bankruptcy of ********) at ********, being the person with the benefit of charging order under section 313 of the Insolvency Act 1986 on the beneficial interest of [/FONT][FONT="][FONT="]******** [/FONT] made by the Birmingham County Court.[/FONT]
As it's an RX4 it would normally be considered within 2/3 weeks. Everything then hinges on it being in order and whether we need to make any wider checks, such as contacting the restrictioner.
I should stress that the form RX4 won;t be with regards the first restriction referred to so I assume it is regarding one of the other two.
Who pays costs to do this is a matter for the parties involved. There is no registration fee“Official Company Representative

JJA80. Thank you for your prompt reply. Does the fact that the earlier reply from Highways is not yet shown mean that it hasn’t arrived or it hasn’t yet been scanned and posted on your system? Highways asked me to get back to them if there was an issue with their reply so they could contact you again to help sort it out.

Until it shows on the system the assumption has to be that it has not arrived.

My buyer’s buyer had to sell their house to keep their sale and have been living with relatives, furniture in store, for some weeks now. I am still unable to confirm when or even if Adverse Possession will be approved any time soon. My sale is on a knife edge and every day that passes without that approval is a day nearer to losing my sale and my purchase in the sheltered accommodation I need. If we just knew that the objection had been removed and LR would then confirm the AP would be registered it would help enormously. In the meantime I thank you for your continued support.0

It is very difficult to provide specific details as this is an important and legally sensitive issue which must be properly resolved so as there are no issues for you, KCC and ourselves.
My understanding is that whilst we have now received a reply from KCC they have asked us to confirm what extent we intend to now register before they will consent to the registration being completed.
This is perfectly normal in my experience so should not be of any alarm. Any concerns would arise IF they did not then agree.
As posted previously I am keeping an eye on it's progress and I will post again when I have more detail.
Hopeful there is some light at the end of this particular conveyancing/registration tunnel now. As soon as KCC have received and responded to our contact hopefully things can move quickly to the desired conclusion.
However neither KCC or ourselves can offer that assurance until the process is completed, which I appreciate you do understand.“Official Company Representative

This morning I recieved an email highlighting a reply recieved from Land registry as to why this application couldn't be expedited.
In the request the solicitor highlighted 3 reasons as to why it should be.
1. Risk on property market - the land in question is being sold, with a buyer in place for the last 18 months any further delay carries risk.
2. Financial burden - it's costing the estate money every day it takes, now running into its 6th month.
3. Emotional - this almost 3 year situation has caused a huge rift and difficultly with some of those in the will.
The reply recieved was along the lines of "we cannot be expedited for those reasons."
I'm extremely confused as a house sale, delay and risk, financial and emotial burdens which is now 6 months in with no sign of resurrection seems well within what you were referring to being able to be expedited last week? If we cannot expedite for these reason what reasons exactly would Warrent expedition?
Is there any thing at all that can be done?

I suspect, but do not know for certain, that we may have said no as no supporting evidence had been submitted along with the request. It may seem over the top to 'ask for more' in such cases as it can be seen as us doubting the requestor but with the current backlog we have to manage such requests carefully.
