Hey, hey, hey - well done. 👏. Judges are starting to line up nicely on the Abuse of Process front. Could you tell us which court and (if there is a name), which Judge gave the Order please?Richard_Snowden said:So I have received a letter yesterday from the courts with the following ruling:
The claim is struck out as an abuse of process.
It states that the claim contains a substantial charge additional to the parking charges which it is alleged the Defendant contracted to pay and goes on to say that this additional charge is not recoverable under the Protection of Freedoms Act 2012 Schedule 4 nor with reference to the judgement in Parking Eve v Beavis.

Even if you had a completely free choice, you couldn't have selected a better court/Judge combo in the whole of England and Wales than IoW/DJ Grand. Judge Grand has been one of the main movers and shakers in promulgating the line on Abuse of Process and summarily striking out PPC claims where irrecoverable 'extras' are added to claims. The chancers are rapidly being outed.The county courts in this part of southern England have started to become a PPC graveyard.

Now you know why current defences are skewed towards getting the claim thrown out due to the abuse of process add-on even though it does not address the core issues regarding the PCN
Had the claimant been less greedy and used a claim like Parking Eye with no additional charges then you would be fighting the core PCN which is what should have happened

The more of these there are , the further the word will spread to all courts and then the whole process may become limited to how it should be instead of a shark feeding frenzy5 -
It would be tempting to write to the court asking fir costs due to unreasonable behaviour
filing a knowingly abusive claim might have a shot
this would be costs to write defence, etc6 -

So Premier Parking Solutions have also felt DJ Grand's wrath! Clearly nothing has happened in that court circuit to change things since 2019 then.
I wonder if some court areas will do this more now, to clear their backlog list?
