Nurses in Cardiff NHS face huge bills
Comments
-
Update - Two of the Defendants who were the 'lead cases' for this have now filed an N164 Appellant's Notice, requesting leave to appeal both the substantive Judgment, and the costs awarded, on a number of grounds.
There have also been various applications and statements filed, challenging the whole basis of the costs assessment.
This will go before the Circuit Judge, and if leave to appeal is granted, the Defendants will need to employ the services of a barrister to argue their case.
Almost £5,000 has been raised via the crowdfunding appeal, but more may be needed for legal fees. Thanks to all who chipped in already, and any further donations welcome here: https://www.justgiving.com/crowdfunding/nhsvindigo
Also will this appeal if heard be at the High Court? If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.0 -

If there is ample staff parking why didn't they just park there? The nurses couldn't park in their staff area because it was full and they have also paid for permits hence the outrage at taking them to court. By the sounds of it the staff at Meadowhall Simply chose that they didn't want to park in the free staff area allotted to them and wanted to park in customer allocated areas instead.
So there are no similarities between the hero NHS workers and the Meadowhall workers, other than the huge number of PCN.s issued.
I have every admiration for Hospital workers and the job they do, my wife is one. All NHS workers should be able to park at their place of work for free.
Where was I saying the workers at Cardiff Hospital and Meadowhall do the same job?
By saying "There is a huge difference between nurses saving people's lives at an overcrowded hospital and people working at Meadowhall!!!" and "So there are no similarities between the hero NHS workers and the Meadowhall workers" you are just belittling the Meadowhall workers because they work in a shopping centre. Yes most probably work in shops, so what, but a lot are admin, catering, cleaning staff just like a lot of the people who work in the hospital and will probably be paid a lot less.
The staff car park at Meadowhall is terrible. It is a long walk from the centre, several hundred yards and for some getting on for a mile from their place of work. A lot of the workers are women/young girls and when they finish work at 10 or 11 pm, they don't want to be walking a long way in the dark on poorly lit roads. As the OP said there have been incidents where women have been accosted. Also the car park is not surfaced and made up of hard core and rubble, again the OP has said several people have sustained injuries because of this.
The shopping centre has 12,000 parking spaces and apart from Christmas time is nowhere near full with thousands of empty spaces.0 -
The real tragedy here, as I understand it, is that there are insufficient places for staff to park when any shift is in and the nearest car parking is 45 minutes away.
Now you don't need to be a genius to see that if staff can't get into work, operations get cancelled and patients suffer. If no additional space is in the area, then a reallocation of space giving staff more space and visitors less is sensible.
But sooner or later the staff may very well be forced to take industrial action.
One question - do administrative senior managers have guaranteed parking??????????????0 -

AFAIK the money from the first crowdfunding appeal has been added to the 'official' fighting fund, the one which I linked.
Appeals from small claims cases are heard at the County Court again, but by a higher level Judge, one with HHJ as part of his title. Many such Judges also sit as High Court judges.
If the losing party wishes to appeal further, and is given leave to do so, it can then go High Court --> Court of Appeal --> Supreme Court.

There is no charge for a basic permit at the Heath
What there can be is up to a 4 month wait for it to be issued if at all.
they have issued 8500 permits for 1770 spaces. almost 50% of those spaces are allocated to essential staff (managers and consultants)
So some staff with permits - paid their £1.05 and parked in an essential staff area!
this is why we fought - plus many many other inaccuracies that Indigo and the very shady ZZPS undertake.
No Duration noted - 1 warden on site amends his device to 1 hr prior to book in a first seen time (WE KNOW YOUR NAME TOO) no photographic evidence ever presented to assist in the assertion of the time first noted.
Signage was changed all over the site in March 2017 - images also taken after the mass replacement and then presented as evidence that those signs had been in place in April 2016 (Indigo Site Manager said this)
Authority (Indigo Contract Manager) stated clearly that they have always had authority in place - and it was not present for the preceding time as when new authorities come in head office disposes of the preceding documents! really a company that shreds what in essence are contractual documents before a 6 yr time period has passed!
We were up against people who were not afraid to lie under oath to get their money. We had the ZZPS witness giving instructions to lead solicitor - Indigo named on claim form, however ZZPS referred case to Wright Hassall.
Who ran it - who was really in charge here - these are answers we have to discover - when a proper team come in to take the baton forwards for the staff0 -
What defeats me in all of this is that on the face of it, this is a massive problem. Insufficient parking for staff.
Now surely this must be a problem that management need to solve as if staff can't get to work, there are severe and massive repercussions. So what, exactly do the trust propose?
It seems there are 2 and only 2 choices. (1)Do nothing (2) Do something.
Have they said (1)? if not, what is their proposal for (2)?
I appreciate this doesn't help with the charges to date, but it is vital for the future.0 -
When we were approched initially by staff looking for help - the fight was over the inequicties of the documents issued, the predatory nature etc. Much confusion as to who actually issued permits - documentation from INDIGO (AS WAS VINCI) stated clearly they printed the cards.
At some point this changed the documentation was never updated to reflect this.
Now we know - the health board are in breach of the duty of care in respect of the over issuing of permits.
Fingers crossed they are all going to get it in round 20
