    yes its a big con , they make more money doing this than renting cars

    however by admitting to being the driver to the scum , they have no need to contact the DVLA to get drivers details , and if you keep them on a hook for I think its 6 mths they CANNOT

    so do the appeal thing (friend in londons address) , then continue , get your friend to send scans of debt collectors letters , then throw a dead mongoose right in there faces with your canadian address

    the people at easirent should have hired legal help to look at the lies they have written , a private parking ticket is NOT a fine , its a ^%&*y INVOICE , only the goverment (or a quango) can fine anyone in the UK !!

    Yep, they want a bit of trough action too. Land another kick to their customer once the PPC has floored him.

    You must make sure that the PPC does not contact Easirent by following hoohoo's advice. Use your brother's current address, because surely when he leaves that one he will be setting up a redirect of mail to his new address with Royal Mail. If he says he isn't, I think you need to take him to one side and have a quiet word with him!

    Do this now. Not a template (do not tip them off that you are a clued-up person).

    Just a really simple appeal, admitting you were driving - we rarely say that! - but in your case, just saying:

    When I parked, we did display a resident permit on our windscreen, and there is no expiry date on it, and it was provided by the resident at the location, as we were fully authorised by the resident (who are longstanding leaseholders, with primacy of contract). We cannot believe we got two completely unwarranted 'parking charges'. The ticketer has made a mistake or you are operating a scam, it seems. Please see the permit (copy attached).

    I expect you to cancel the parking notices immediately.*


    Do this for both the PCNs.

    As long as the appeal arrives, no letter will EVER go to the rental firm.

    Do not say it's a rental car, no hint of it!

    Get proof of sending the letter of appeal, if you must post it, if UKCPM don't give an email option on the 'PCNs'. That means getting a free certificate of posting on Monday at a PO counter (not ''signed for'' not ''recorded delivery''). Staple the receipt the PO give you to a copy of your appeal letter and keep it in a file safely. You can send one appeal for two PCNs as long as you state both PCNs at the top, clearly.

    If you use the London address, ask your friend to pass on all letters.

    My brother in law is about to move out of St Albans soon, so I don't think I ought to appeal using his address - correct? I do have a friend in London who's address I could use for this approach, should I do that, or shall I send the appeal letter and give my Canadian address?

    If I understand correctly, if I give my Canadian address from the start of the appeal, then the PPC will most likely contact Easirent, who will pay up. In order for that not to happen, I need to drag the appeal process on using a UK address to make it look like I'm a resident. If at the end of the appeal process I win, great. If not, I tell them you can contact me at this Canadian address, I've moved, and hopefully they wont chase this any longer. Am I understanding this correctly?

  • So to recap, and FWIW my view, would be that you should admit you were the driver and then appeal (on whatever basis you can muster) using your Canadian address. Get all correspondence sent to Canada (not via email or to any other address).

    The parking company will need court permission to serve outside the jurisdiction if they wish to start proceedings. It is doubtful that they will go to the additional costs and effort.

    If you admit that you are the driver POFA will not apply and there should be no need to do a DVLA search and, as noted above, there is no reason why the vehicle should be identified as a rental in any event. However, there is a risk that the parking company will try to seek details of the registration, because of this.

    For completeness, you could write to Easyrent to put them on notice that you are dealing with a parking ticket, which is being appealed and to request any correspondence is passed to you directly and instructing them not to settle the invoice if approached to do so. That will allow you to refuse to reimburse them if they do settle up without contacting you first.

    Thanks so much, I'll do just that. I won't use my Canadian address as it would make it obvious it's a rental I think (why and how do I have a UK registered car if I'm living in Canada?). Correct me if I'm wrong please.

    I don't think I ought to let Easirent know anything, as they'll charge me a £55 admin fee regardless if I do let them know. It's in their page on penalty charge notice (I can't link it here for some reason). I'll avoid that £55 admin fee if they never find out about it. But they've also mentioned in the page that they wont pay the fine/PCN, that they'll just charge the £55 admin fee and its the driver's responsibility to pay it back... "Easirent will only take the cost of the admin fee, it remains your responsibility to pay the FPN we pass to you. The same applies to PCNs such as exceeding the speed limit, entering a bus lane, stopping on a red route, etc."

    The problem is that if you don't tell Easirent, they'll pay the invoice for you and charge you for it + their admin fee, which will probably be about £150-160 in total.

    Also, car rental companies are notoriously stupid when it comes to dealing with PCNs: no matter how many times their own trade body has told them what they are actually supposed to do, they do the dammed opposite...

    I would tell Easirent that you are taking this over and send them a copy of your correspondence with PPC. Point out that if the PPC contacts them, they are acting outside POFA and that in no way will you carry any costs for "admin" and that you will put any charges they choose to apply into dispute with your card company.

    Thanks everyone. I'll do the following as per suggestions above:

    1 - Send appeal letter to UKCPM, using my brother in law's current St Albans address
    2 - Let Easirent know I'm dealing with this on my own, and they should not act if the PPC contacts them otherwise I will dispute any charges
    3 - Have any mail from UKCMP forwarded to me/scanned and emailed to me
    4 - If the appeal is unsuccessful then appeal with the IAS, and continue the process until 6 months have passed (essentially beginning of 2018), after which "I've moved, here's my Canadian address".

    Thank you all very much. Shall I keep this thread updated with the results?
