Whos to blame car accident

Hello Guys and Girls,

I am having anxiety about the car accident i had this morning,
I do believe in my eyes they are to blame, I think the policemen even said he can see whats happend so dont worry, but i just spoken with my insurance who said because the other people didnt admit liabilty it will be down to the insurances to work out,

    On the basis of the little information, the third party has failed to give way as required to traffic coming from the right.

    However... Ask yourself, how did you not see them coming and fail to slow to avoid an accident.

    Once insurance is in progress, far more important to work out how you are going to avoid that situation again. I can absolutely guarantee that this was an accident that didn't need to happen, regardless of the third party pulling out when they did.

    As you can see from the second link, The area in front is blocked, The lane they come from, Is where the big hgv is in the picture so its completely out of view,

    So presumably if your view is limited you were travelling at a speed such that you could easily stop in the distance you could see to be clear?

    After all if you can't see the emerging traffic until late, it's a fair bet they can't see much of you either...

    So were you travelling too fast to stop in the distance which you could see to be clear? Or not paying attention to emerging traffic? Doesn't matter it was their fault, still leaves you a pile of dung to sort out.

    To be fair, both of your diagrams , you suggest that you are not in the left most lane to exit at the junction you require.
    That's not to say the insurers will look at it that way, however as the poster above suggests, you should be looking to avoid accidents even if the other driver is an idiot for pulling out when it's not clear to do so, just so much less hassle in the long run.

    100% other driver's fault, although a bit of defensive driving on the OP's part could well have avoided the impact, even at the expense of having to do a lap of the roundabout.

    I completely wish i swerved the car more or something, But as my wife said to me if i had swerved would of hit somebody else, And the reaction time was so small, The road they came from which cut across my pathway is so small its a tiny little road, The man said he was trying to speed up to get past as he was waiting for such a long time, The roundabout is very very busy, I did speed up fast to get onto the round about myself but was only 25mph , My number one concern was nobdoy was injured, The other party was in there 70s so i was very worried about them, As i said to them and the police main thing is nobody is injured , They was very shooken as i was myself, I just cannot really afford to have my premiums go up and lose my no claims This is why its a concern , of who is to blame , I was off for a nice family day with my wife and 2 children i certainly did not set out for this to happen,

    Those on roundabout have right of way. Other driver pulled out, easy win for you.

    Yep that extra lap would have saved a lot of agro now and later , personally tackling that roundabout I would have chosen the middle entry lane indicating and moving into the left lane of the roundabout.
    I wasn't there.....but this is what I think happened.... the 3rd party took a chance to enter the roundabout as the OP wasn't indicating and assumed the op was continuing around the roundabout :o

    Not quite. If the other idiot hit the passenger side of the car, then yes. If OP struck the driver side of the other car, then it will be a tad different!

    As it appears OP hit on the drivers side, that would imply the other vehicle was on the roundabout when the accident happened. I hope OP is fully comp and has legal cover. Do not admit anything.
