    While he certainly can try, there is no weight of law behind Chargeback.

    Will the Bank agree to refund even though the website purchased from is obviously fake?

    I have my doubts..
    you have the Visa and Mastercard chargeback scheme which is just the same as section 75 with a credit card.

    Yes if its a fake site and you paid by card you will be covered

    i have just made the author of the Opencart theme they are using aware of this being a fake site. also informed Nominet of the use of the .co.uk domain

    but they have the weight of the 2 largest card providers, who do clamp down on such fraud and could make it difficult for whichever payment gateway used on the site.

    Who presumably won't want to take the hit in these circumstances and are under no legal obligation to do so....

    Section 75 is that the credit provider takes liability when the transaction is not completed e.g. delivery of goods.

    Chargeback is you informing the card provider you want the payment reversed as you no longer authorise it, they typically need an explanation and will probably do some sort of investigation. The issue in this scenario is if the company the money was paid to the money is not recoverable then you may not get your money back whilst with S75 you would get it back. So the chargeback relies on the card company able to recover the money from the receiver.

    Matercard and Visa would never take the hit, that would be the bank as all Visa and Mastercard do is provide the cards and assurance, but what MC and Visa can do is if a certain payment provider ( lets say Paypal) get so many chargebacks etc, they could revoke that provider from offering their services, so would mean Paypal could no longer take any payments from Visa or Mastercards, which for a payment provider will be the end of them.
    The last provider that this happened too was Liberty Reserve when they were found to be money laundering..

    That won't achieve anything. Opencart software is free open source software that can be downloaded and used by anyone. It will be stored on the scammers own or rented servers somewhere. The maker of the theme won't be able to do anything and probably won't care.

    The best bet is to try and find out who is actually hosting the website but even that might be a dodgy host who doesn't care about content.

    *edit* The host or what appears to be a DNS forwarder (?) is registered in China so pretty much zero chance of getting them to do anything! https://who.is/whois/dnspod.net

    I know who to speak too at Nominet as been a Nominet member for 20 years and they have revoked domains used in scam sites. the nameservers and IPs are on the chinanet network, so yes they will do nothing, even if you report spam emails to spamcop that originate on chinanet they dont even files reports as they know they just get ignored. Chinanet is state owned by the chinese government
