When my dentist friend did not pay me the £1,000 a judge had awarded in June, I engaged DCBL at a cost of £66.
DF went to another judge and, without consulting me, she stayed the writ. He blamed court officials for mucking up the paperwork
I have three times now asked her why, and can I have my money back please, she has not replied.
My next letter on the subject will be a complaint against her for failing to reply/maladministration/misuse of public office/bloody rudeness whatever.You never know how far you can go until you go too far.0 -
Do I need to do anything else? I've submitted a new claim with MCOL for the money they owe me, what happens next? Doubting myself here thinking I haven't gone down the correct route. Should I have asked the county court instead?0

Yes. Wrong route, no-one said start a claim. You've wasted £25.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

MCOL doesn't have an option to request a warrant of control? I think its time I just leave this be now. I've fought them long enough and I don't know where it would end and how many more mistakes I would make. Many thanks to everyone once again.0

I phoned the court again this morning, as I was having doubts, to ask how I enforce the court order. They said they were not allowed to tell me how I go about enforcing the order, only to say all the information is online.
There's a form numbered N323: Request for warrant of control which would send in bailiffs and the fee for this is £110. As far as I can see that doesn't guarantee they can recover the money. I've closed the claim on MCOL now.0 -
You have to request a Warrant of Control (as opposed to a writ of control, since it's under £600). You apply to the court that made the costs order. You have to pay a fee, but this will be added to the debt.
Form N323 and the fee is £100 according to EX50. So you have to shell out another £100 BUT this is added to the debt the county court bailiffs will enforce.
I'd call the court and check because the government leaflet is difficult to follow, one minute it says you can do this for under £600 the next it says you can't.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users.
