Amazon seller scam

On the 17 May i ordered a Samsuns s8 from amazon.com and it shows that has been delivered to a resident and signed by me at 11.06.
we are family of four living there ( we live in flat)
I tried to explain to them that it was impossible that the order was delivered as me and my brother were at work. While my mother and dad are in Itally and can provide boarding pass and they can verify it with easyjet
They said me that it was signed by me and then they said it was handed to a resident and signed by me, The fedex courier tracking information clearly says that is was signed by me.
They asked me to file a police report and i did and they rejected my claim as they keep saying it was signed by someone so it was delivered and now they are not answering .
Like i said in police report at 11.06 me and my brother were at work and i give them my employer number and said that i can give them any footage of me at work as we have security cctv camera.
But they still kept saying that is was delivered so they were not responsable as they did their job but they didn't!! that order was supposed to delivered to me as it was an expensive phone and not cheap stuff.
They said we will track the phone, talk with courier but still havent received any answer, i can accept a replacement or a refound but can't afford to lose so much money.
What should i do? start a chargeback?

Firstly did you purchase on Amazon.com or .co.uk? Did you buy from Amazon or from a Marketplace seller (i.e. a third party)?
What does the tracking actually say? Have you entered the tracking number at www.fedex.com rather than any link provided by a third party? Is a copy of the signature available?

Yes, more or less (assuming you have undertaken the checks suggested in post 2 above). If I paid by credit card I would make a section 75 claim, otherwise I would make a chargeback claim. (Section 75 is slightly better but as the item failed to arrive a chargeback should also work.)

Chargeback is probably the way to go though. Internet forums are littered with questions just like yours about expensive items going missing despite apparently being delivered and signed for at the buyer's address. No one seems able to provide a decent answer as all the parties involved simply blame each other. Retailer says they have proof of delivery, therefore it's not their fault. Courier says they have a signature and besides, their driver is confident they delivered to the right address, therefore it's not their fault. Buyer says I still haven't got the item, so therefore it's someone's fault. And round it goes. Ultimately though, your contract is with the retailer - which is why a chargeback can work.
Also, it is best not to use emotive and potentially libelous terms like 'Amazon seller scam'. At this stage, you have no evidence for who is at fault for your phone going missing. Stick to the facts and you are far more likely to succeed in getting your money back0 -
Neither a chargeback nor Section 75 claim are likely to succeed given the seller apparently has proof of delivery, it would be for a judge to decide on the balance of probability who is to be believed.
Without further information it's difficult to advise further. Scammers love both Amazon and Fedex, both being reputable brands for which you can easily knock-up a lookalike site.0 -
i bought from amazon.com and it was from a amazon marketplace seller.
yeah i have a tracking number and say delivered and signed by me at 11.06.
copy of signature is available but for sure thats not mine.
and yeah my brother was at work as he works with me0 -

In which case the transaction is bound by USA laws not UK laws.
Best thing you can try is an Amazon A-Z claim and see how it goes.0
