    So do you think i will need to go to judge for resolve this?

    If you make either a section 75 claim or a chargeback claim and it is denied without a proper investigation then you can complain to the Financial Ombudsman Service (FOS) that you were not treated fairly as your claim was denied without being properly investigated. Then FOS should investigate and "judge" your claim. If you still don't win you can still take legal action. If however you take the matter to court then FOS will not get involved.

    So my suggestion is first try a chargeback/section 75 claim since that process is free (though perhaps not that quick) and still leaves open the option of legal action later.

    Certainly worth trying S75/chargeback ... but I doubt court action is available, as any such action would need to be initiated in the USA most likely.

    they rejected my claim saying that order is been delivered and signed so they did their duty.
    i asked how you can confirm it as i can proof that i wasn't even home but they ignored it and said they can't give further explanation.

    But it was delivered to your address, no matter if you were home or not, if it was signed by someone at the address then it was delivered

    but to who as no one was at home? my brother works with me and my parents are in italy, so how the hell got delivered to my address?

    you also state
    They said me that it was signed by me and then they said it was handed to a resident and signed by me
    if they handed to a resident then it could not be you that signed for it, but Amazon have 100% NOT scammed you.

    You purchased from a USA website, the item was sent to you and courier says delivered and signed for.

    To me this is a Courier problem, but unless you employed the courier then you have no contract with courier, this has to be down to seller or whoever employed the courier.
    All the CCTV showing you at work means nothing as i stated it is delivered to an address and anyone at that address can sign for it and it seems the courier has a signature from your address.
    You would need to apply USA laws in this case, even if you did get it them 9/10 it would have been useless to you as from a USA site it would only have a USA warranty and work on USA wavebands
