E2Save cashback con trick! Is it legal?

Well THAT depends. 1) you COULD send the previous bill between certain dates IF they stick to their way of handling claims, or you COULD see the planned bill arrive later but within 28 days (one calendar month if you printed out the right t&c as I recall without checking) of its date and then sue them for the lot.0

My question is,,,,,,,,,,will this(above) be correct, or is it possible for me to find another variation of this, completely diofferent somwhere else, on which they could void my claim................
Re Pricematch...There is no mention of price match anywhere and my "your offer explained leaflet" says its a clearance phone.......Please dont think i'm doubting what you say....its just i dont understand the difference in redemptions....
Re sendind a photocopied bill, that is also in my account re "how to claim"....but again i take your word for it...0 -
Guys, they didnt earn £440 in the first place, so they are bound to make the T&C's difficult. Why people keep chasing these false promises all the time I dont know. The company had all thier commission a week after you connected, so why couldnt they pay out a week later, rather than waiting for month 4 etc. I assume its because most people wouldnt qualify for claims due to lateness or Royal mail etc.0

bassman:- You should have copied EVERYTHING at the time you ordered. I am sure it IS a price-match deal, in which case (had you printed out the t&c at the time) it would be quite clear that originals only are acceptable etc. I'm afraid anything you see on there now is likely to confuse and the "dates" you see are not exactly defined. You have a lot of reading to do on these threads. Start with this page:-

lovelyguy:- Although I do advise anyone NOT to take out cashback deals at present unless they really know what they're doing, t&c have always been difficult. They ARE far worse now, especially since some major companies aren't actually following them and seem to think that's acceptable and (more to the point) they can get away with it. However, you are a dealer not offering such "generous" deals and so do have a vested interest - which I understand when you observe the way your competitors are all operating in this market AND it's so obvious the figures don't add up. Some of us we are perfectly prepared to go for these deals with our eyes open - and have done VERY nicely out of them, thank you! So although I see where you're coming from I cannot agree that the deals are not worth doing IF you're experienced, confident and aware enough to partake. I've had about a dozen totally free contracts, got about another 10 for friends and family and to date all of us have obtained all of our money without too much difficulty. I fully intend to continue even though the dealers ARE becoming even more dishonest.0 -
MJ, I fully applaud what you've done in getting everything owed to you. You are one of a select, bright few who has achieved this to date. I dont have a problem with cashbacks, as long as its done properly, and nobody loses out. Companies who scam customers are in this business very short term, and it tars us all with the same brush, which I'm trying to prevent. If your not switched on, can be bothered to read T&C's from front to back, adhere to everything they ask, and hope they dont go bust in the meantime, then you've got a 50-50 chance of seeing it through.0

Ok i had read that, but theres so much to take in....fortunately i may be one of the lucky ones, whos terms and conditions whether it be 4th month or 120 days fall onthe same bill
I received my phone on the 19th of July, and my first bill was dated 28th, so my fourth month is November and my 120 days is also November.......or is this incorrect.
This is my fifth "free" redemption in a row, the problem with this one is i had urgent other business at the time, so lost track of the situation.0 -
bassman:- You aren't fortunate! They aren't following the t&c you signed up to! If you send your November bill you'd better make sure they get it before 19th December or you'll get a very nasty surprise!
lovelyguy:- If my chances were only 50%, why have I got 100% over the course of more than 20 contracts? Further, I agree (again) that many of these dealers ARE in it for the short-term, but the same can hardly be said for the likes of cpw. As for many NOT getting their cashbacks, I can live with that; if I couldn't I wouldn't be one of those who do!0 -

Ok....still confused...how do i know, and how do you know which TandC's i signed up for........and do you agree it should be the November Bill, and why shouldnt they receive it before the 19th of December...even if i have to deliver it personally...
Ive actually just found a folder (on my dektop)for E2save with the redemption TandC's in it dated 17/07/07..
which says
11 Months FREE on O2 600 min + 500 sms 12m
Send your claim within 30 days of the date stated on the relevant airtime bill, to us and we will credit you by cheque with £88.00 each time.
This will save you £440.00 over the 12 month duration of the contract. In effect this means that your average line rental per month over the contract period is £3.33 per month.
Please note: the above calculations are based on the basic line rental of the tariff and do not include itemised billing.
The Terms and Conditions of the price match deals vary from our normal Terms and Conditions. Please discard the Cheque Back Leaflet in your welcome pack as the Terms and Conditions differ for this offer. A summary of the price match deal terms and conditions are detailed below.

Does this make my situation any better.
And i note this does mention price match, as you indicated0 -
Exactly as i expected - no need to copy/quote it all; I'm very familiar with these.
Yes and no. And why might you not get it there by 19th December? Well, apart from the postal strikes which may or may not affect you then, it will take a week for you to even receive the bill. Many DON'T send their claims in immediately (or could be away for a week or so) and THINK - as it SAYS - they have 30 days from the date of the bill. They don't unless they're prepared to sue! In addition, they WILL NOT accept copy bills as you thought; and IF you've signed up to ineternet billing you've had it in any case unless you change THAT back immediately to paper billing.0 -

I do not want to confuse you and I know mobilejunkie is trying to help.
Having said that I would follow the T&C's YOU signed up to and have a copy of to the letter. If they then decide to disqualify your claim because of changed T&C's you would have a very good case in the Civil Court.
I am not wanting to start an argument and any decision is yours.
