    If you don't provide the judge with copies, he/she is unlikely to have any knowledge of the detail you are relying on.

    The claimant should also receive from you a copy of anything you provide to the court.

  • Sorry for being a pain just want to get things right. Can I ask when I refer to a particular letter in my witness statement I use my initials ie, ab1, if I'm referring to another persons witness statement do I use their initials?

    Would anyone know where to find out the details of the txt size of signage? Have checked the IPC manual but they do not stipulate actual txt size, would be most grateful.

    I've seen a number of defence drafts over the past few months with this included. Do a forum search ('Show Posts', not 'Show Threads') using 'Defence Signage Text Size' (or similar).

    But I've never seen this being a showstopper, so don't lose too much sleep over it - there are many more important issues to include in any defence.

  • Well off to Court next week, have received the claimants witness statements and found that they have not provided one photograph of the signage on the day of the ticket, albeit lots of photos after the event, do you think this is a massive gain on my side?
    If they have not supplied any photos of the signage dated and timed who is to say what was on the signs, or even if any signs were present!! No wonder they would not provide me with the information I requested, oh by the way this is a claim by UKCPS.
    Would be interested in your opinion.

    Yes, and doesn't the IPC CoP say that there must be evidence of where a sign was in relation to the car? Not sure...check that. Sometimes the landowner contract says the PPC ''will'' take photos evidence including the signs and the car together. Otherwise, you can argue, there is no evidence of any breach of any signed terms on the material date.

    Can we see their WS? Host it in Dropbox with as much of the 'evidence' as you can show us, including the ''landowner contract'' if they have evidenced it.
