    Looks good except I spotted this (remove anything about the BPA CoP, as they are IPC):

    5. BPA Cop breaches – this distinguishes this case from the Beavis Case:
    a. The signs were not compliant in terms of the font size, lighting, or positioning.
    b. The sum pursued exceeds £100.
    c. There is/was no compliant Landowner contract.


    I agree with Redx, email the defence to CCBC as a signed/dated document (claim number and 'defence' showing as a header on every page) scanned back in and attached as a PDF.

    Didn't think I would get the DQ so quick, but just have a few questions to ask if at all possible.
    Have read bargepole's thread regarding the procedures but still a little vague on some points.
    1. In sect D3 (Witnesses) do I put down the number of written witness statements into this, as they will not be attending but still witnesses.
    Also on the header letter it mentions when the N180 is to be returned by, then address and finally says "and serve copies on all other parties" do I have to send a copy of my N180 to the claimant?

    Additionally I requested information from UKCPS which of course they did not disclose but said they would only do this on the Courts request, should I send them either a Part 18 or SAR, still unlikely they will provide but at least I can show the court I've asked and they've declined.

    Yes (including you as the first witness counted) and yes, from now on, you copy in the claimant.

    Because I've got so many witnesses/statements is it possible that the second conversation I had with the Ticket Attendant that the two witnesses who were present could sign my statement that they were present heard everything and could acknowledging their presence, or is it better to get each and every witness to make their own statements, just thinking of paperwork and time here.

  • Filed the DQ which has now been received by MCOL, and had notification of the transfer to Sheffield County Court.
    Although I filed my DQ and sent a copy to the Claimant, they have not sent me a copy of theirs, worried because I don't know if they have tried to get the claim done through "papers" which obviously I would want to object any ideas.

    UKCPS have never been known to ask for a decision on the papers (that's a Gladstones tactic). Silence is good, it sounds like what happens in CEL cases, where CEL never proceed beyond DQ stage when well defended.

    Why not ring CCBC if you hear nothing by June (not this month, too soon IMHO)?
