    The more you search about UKCPS the more dirt you find, they say this particular instance in Sheffield was a isolated incident, if this was the case how could it have happened in Warrington as well.
  • I'm not sure the reasons for the UKCPS suspension is relevant to my particular case, or is it? Do you think I should still put this in my WS?

    Can it be publicised or are there such things as FOI's that are 'for your eyes only'?

    The aim of the Freedom of Information Act is to make information available to the general public. You can only obtain information that would be given to anybody who asked for it, or would be suitable for the general public to see.

    Quick Question, in my WS if I use the information from the FOI do I have to print all the pages and add them to my defence, as well as the IPC Code of Practice etc, as these will make for many pages. I just thought you had to keep your WS as short and sweet and straight to the point, also do these copies have to be sent to the Claimant as well.
    I realise you need proof to back up your WS, but wondered how much you need to add to what is already a hefty bundle.

    You wouldn't need all the pages, just the relevant ones from the FOI, and only a screenshot of the relevant numbered paragraph you are referring to in the IPC CoP.

    But yes, your WS that you sign is short(ish) and has the facts. But your evidence bundle might well be pretty long.

  • OP, your court directions will be for service of a WS and any documents on which you seek to rely
    Some documents you will refer to in your WS, and these should be exhibited to the WS itself.
    Eg. "I met on x date with x from my company [say their position] and y from the PPC. Y happened to be the same parking warden who had issued the pcn to my vehicle. Y said xxxxxxxx. X minuted the meeting, and s/he and I have both signed the Minutes as an accurate record of the discussion which took place. Y has refused/declined to sign the Minutes. A copy of the Minutes, signed by me and X, is attached to this statement marked AB1" [AB being your initials, and you refer to each exhibit numerically - either you have one big exhibit AB1 and you paginate it and refer to "attached to this statement at pages x-y of the exhibit marked AB1" or you do a whole series of exhibits AB1, AB2 etc].


    The purpose of the WS is to set out the relevant facts, not the legal defence (the facts will support the defence- eg your defence is that you had authority to park - the WS will set out how you had that authority, the issue with the old/new permits and so on).


    There will be other documents that you have which you wish the court to see, but which you don't refer to in your WS. These go into the "other documents" category, and you serve/file a copy of them along with your WS and its exhibits.


    Case law you can refer to but you don't have to provide with the bundle, you just have to turn up with these on the day.


    So your bundle (ie all the documents NOT exhibited to your WS) will consist of anything not exhibited already.

  • I've read the public link to the FOI emails. Details of the site have been redacted. How do you know it is the same site?


    If we know it's the same site, is it worth rattling cages in the DVLA that the rogue ticketing is STILL going on and wrongful requests are being made for keeper details?
