That is highly possible as MIL get scared many times and pull out of cases.
That is why you must attend the hearing so if they are not in court you win by default .... just as they won against you by default

I will try to word it so you get your costs awarded back at them straight away, if possible, if not then your £255 is claimed back within the counter-claim that I suggest is included. The counter-claim costs £25 or £25 depending upon the sum claimed and that too is claimed back, ultimately, as long as you win (and there is a stack of evidence to assist).
I will reply to your pm. I will also be asking you to email the DVLA and to put in an ICO complaint at the same time, to pave the way.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
