Someone has not paid this debt you mention. It may be completely unrelated to you, which is why you send the Prove It letter, to establish just where the debt came from.

I think its more like someone with the same name somewhere else - Because some time before the first letter from the OC, I had another letter/debt collector demand from Sky.

One phonecall to Sky and it was resolved completely. Full apology, written confirmation and shortly after an apology/written confirmation from their debt collector.

Customer service, even to non-customers has its plus points - Sky went-up considerably in my because of that.

Send the Prove it letter, and deal with them from there. If it can be shown that the debt isn't yours, they will go away.

First time round I got a load of meaningless waffle and a - "We believe we have another address for your account on file and cannot do anything further" line.

So a "prove-it letter" seems easily evaded? Not helped of course by them hiding behind "data protection" to avoid disclosing anything.

I know where I've lived for the last few decades, so I can be pretty confident that whatever address they may have, it won't be mine.

Done longsince - My bank were happy to do the check for me and are on my side in the matter.

What has your bank got to do with this?

Only you can access your credit files, not your bank.

You should check all 3 of your files to see that there is no adverse accounts or information that shouldn't be on there.

Did you send the proper Prove It letter? it is here: https://www.nationaldebtline.org/EW/sampleletters/Pages/Complaining-to-debt-collection-agencies-that-you-do-not-owe-the-debt-%28sole-name%29.aspx

They cannot ignore it, nor quote data protection nonsense if your name is on the letters you receive.

If they allege they have a debt you owe, they have to prove it to you upon request. if they do not, they cannot enforce it.

However, just writing a generic letter saying "This debt isn't mine, please show me proof" will likely get the responses you got. Because these guys are slippery, and only respond when they're compelled to.

Yes, it was the proper prove-it letter.

So it seems that they can and do evade.

    Indeed they can it seems.

Well, evasion wont help them if they want to actually get any payment. If they can't prove the debt, they can't do a thing about it.

  • I had a letter from them yesterday saying needed to talk to me. No information as to why I have sent them a prove it letter recorded delivery as I was so worried I am not in debt or owe any money. They have not stated in letter what it is about but they want my date of birth. Is this legal I'm not giving them that.
  • I received a letter from Lowell finance no info at all what it's about they have my name and address correct but they want my date of birth. What should I do

    Evening all.
I have got a letter from Lowell Finance Ltd today, stating I owe money on an O2 (UK) Ltd account.
At no point in history have I ever had an O2 account. I haven't even had PAYG O2!

What's the score and what do I do?

They're not called 'Lowlives' for nothing.

Pay nothing, don't phone them - in writing only from now on.

As others have said, 'prove it' letter, then if they can't substantiate (and they won't!) and they've been at your credit records, letter of complaint - and if they still won't remove, Ombudsman Service.
