  • If you look at sheriff courts daily rolls in the Angus area you can see other car parking companies listed for hearings.
    The person who lost the case because they didn't notify the company it was in England.
    The driver not rk parked in 2 separate car parks 1 euro car parks - signage confused them and then it appears some mug removed the paper ticket before the driver returned.
    The 2nd car park a parking eye car park basically the driver thought it would be ok.

    Quentin it said 4 things to do and it said not to ignore parking eye on the drp link you sent me.

    The drp link makes it clear you can ignore them.


    The advice not to ignore PE does not apply to residents in Scotland!


    If you do get any correspondence from court then don't ignore that.

    ENGLAND NOT SCOTLAND

    The interpretation of that case is probably incorrect, simply because there is no obligation to name the driver

    Regardless we do not want Scottish readers to get confused by this.
    In Scotland a PPC needs to establish who was the driver. PERIOD.

    In the letters they say because you haven't contacted us we assume you to be the driver or because you haven't contacted us you are admitting liability.
    That is why I'm concerned because in a way It's like agreeing with what they say by not denying it?

    scottish laws were simuklar to e/ni untill 2012 , but we had clamping as well , we kicket the clamping out and accepted POFa2102 , which said that if they followed the strict rules then YES the owner was guilty , but most have just chucked POFa out , because they are that thick they cannot do it


    POFa never applied to scotland , and you do not need tosay who the driver was , or indeed reply to them

    1: If they did not drown when dunked, they were guilty
    2: If they drowned when dunked they were guilty.

    Same as saying

    Not in England. No alleged witches were ever burned to death in England, they were usually hanged. (I don't know what happened to alleged witches in Scotland because the POWA 1412 didn't apply.) :D

    If DRP get someone corresponding with them then they'll know they have a fish dangling on the hook. Therefore they'll simply up the ante and continue the letters for longer.

    No reply = DRP will give up earlier.
