All we have been asking for is to see a judge on this matter

How do you mean "see a judge"?

Have you ignored other correspondence from court?

Even if RK wasn't the driver ?

The driver wants judge to hear just what happened and what's wrong them which made them a 8 mins late getting back to car. Payment was made for a ticket to park on the car park and what happened couldn't be helped . Still arrived back to car before the so called 10 min grace period.

No parking charge notice was given to driver and nothing attached to window of car. Just driver and attendant had abit of an argument as he was not interested in what driver had to say.

RK just owns the car but doesn't drive it

Yes the RK is liable if they were the defendant. You did get THEM (the defendant) to complete and sign that DQ didn't you, not the driver, who has no right to speak to a Judge - except as a witness.

It's nothing to do with the driver. Only the Defendant is involved here. Did that person sign the 2 x DQ forms?

Never ignored no letters and forms and yes RK has completed but not had the opportunity to be in front of a judge on this case and RK should have this opportunity

So if the defendant knew nothing about the hearing then consider the set aside route - but realise the cost of this which may be simply increasing the whole cost of this episode.

Maybe take all the court docs to the CAB and see if they have someone who can go through them with the defendant to see what has gone wrong for the defendant in the process (don't expect too much o the specifics of the defence from the CAB, but they may be able to assist on the procedure and how this has happened without the defendant being aware

    What about the questionnaire stage?

Did the defendant send that back?

Yes 2 questionnaires they have had now. As stated first questionnaire got 'mislaid' so resent it out.

This is why does make sense

I would ring the CCBC next week and find out how they've lost 2 x DQs.

    You said

Emailed court to say that forms were posted. Heard nothing for a good few weeks then next letter saying case been struck out of court and got to pay a sum of money.

That is probably the problem. You have to be very pro-active in matters concerning courts, councils, taxmen, etc., waiting for them does not cut it.
You never know how far you can go until you go too far.

Spoken to the CCBC- very unhelpful. Really not sure where to go next other than CAB. Haven't got money to take it to court . Whole point is there was a ticket paid for and only 8 min late back to the car it's stupid
