A traffic app may well fall within the realms of "an interactive communications device" as they often receive written messages warning of delays and diversions but I can't see how a satnav would count as it doesn't receive any written messages, documents or images.0 -

The legislation applies to a device "which performs an interactive communication function by transmitting and receiving data."
A satnav receives data, but the word "and" seems to exclude a simple satnav, but not one which transmits its position to enable it to relevant traffic info.0 -

Do any satnavs actually transmit the vehicle position or do they just receive all local traffic data and compute routes and detours internally?
Even if they do transmit the vehicle's position, what is stated is only a loose interpretation of the actual legislation. There is no mention of the word "data" actually stated in it.
For a device to qualify as being interactive, it must transmit one of the following:

You need to read the whole regulation. It specifically refers to data (section 4):
'A device referred to in paragraphs (1)(b), (2)(b) and (3)(b) is a device, other than a two-way radio, which performs an interactive communication function by transmitting and receiving data.'
The full text of 6(c), which you have quoted selectively, is:
'“interactive communication function” includes the following: (i)sending or receiving oral or written messages;
(ii)sending or receiving facsimile documents;
(iii)sending or receiving still or moving images; and
(iv)providing access to the internet;'
The key word is 'includes' - these are examples, not a definition.0 -
So why doesn't the legislation simply state "any device which transmits data"?
Another way for them to have written it would have been to state "Includes but not limited to", but they chose not to do this.0 -

Can you imagine the outcome in court if someone was prosecuted and the CPS stated that although the specific thing that they were being charged with wasn't stated in any legislation, there were examples of similar but different things in there!0
