Your local court. If you win you immediately ask the Judge and claim your costs including travel, parking (!) and loss of leave.

We rarely see one lost here, NEVER v PCM on this forum so far (never seen one lost v Gladstones).

In my opinion, you should also seek unreasonable behaviour costs under CPR27.14(2) (g).

Demanding £150 from someone for parking outside their own home is totally unreasonable. No-one has suffered a loss, no-one has been inconvenienced, (apart from OP), or obstructed. The object of employing a parking management company is to deter riff raff, not prey on residents.

Also. have they supplied all the information for which you asked and done in a timely manner that which the court decreed? If not more grist to your mill, read this:

    https://keoghs.co.uk/keoghs-insight/aware/costs-orders-for-unreasonable-behaviour-in-small-claims
You never know how far you can go until you go too far.
  • The court asked for essentially proof of when they sent the amended particulars, presumably because the court either never received them, or they were received too late.

If youre not sure what it means, ask the court! however presumably you have a letter fro mthe court ordering the claimant to file amended particulars?
  • yep the mail just came yesterday, asking Gladstones for the amended claim particulars. Gladstones sent them their photos etc earlier. They never actually responded to my questions - only communicating with the court.
  • Hi,

I have just received a confirmation that the case was struck out on the 2/10/17 due to the Claimants not complying with an order for service.
Is there anything I need to do in this case now? Can I claim back some money for my expenses and time?
I am happy that I don't have to waste more time for this anymore.
Thanks for your help, especially for you Coupon-Mad.

    Thanks.
  • anyone? any advice?
  • Post #2 of the newbie thread, about half way down there is some info how to submit costs after a discontinuance.

You may be able to amend the info there for your case which was struck out.

I assume the strike out order came from the court yes??
