Get rid of the capitals, I gave it like that to you, just to remind you not to suggest a driver...

That would be belt and braces, but why not?

If you decide to send a letter too, use normal post (not signed for), but get a proof of posting from the post office (foc)

Ok, letter has been sent. What to expect next? Also, if I make it to the court how and what should I try to claim back if I win? Thanks.

Work on the assumption they proceed to court.

Till you get this confirmed spend a little time familiarising yourself with the process.

Help and links on this are in the newbies FAQ thread.

You have 14 days after getting a court claim to respond (always extendable to 28,- all explained in the FAQ)

So no need to spend too much time on it now

A court claim to acknowledge & then defend, with our help. They will hardly glance at your letter but it looks better in court later if you can show you asked for more details but were ignored.

Start by reading the links & info in the NEWBIES thread under 'Small Claim?' and do the acknowledgement on MCOL online.

Then search the forum for 'PCM Gladstones defence' to find other recent ones written, to crib from. You could immediately pay £25 to counter-claim if you have grounds to do so and if the data was first supplied to PCM by the DVLA, and/or could just concentrate on winning this defended case first, then separately consider revenge in a later claim (if your case is suitable).

Personally I think most people should concentrate on defence first, winning the case, then serve revenge (any claim for compensation) cold, if they have grounds, later.

  • Thanks.
Just found this gladstones one, it is relevant and not an old defend. I am probably read it through and remove / add bits and pieces and show it to you when finished. As I am not a native speaker it takes me a longer to read, understand and write such of legal worded text. I am probably try to counter claim as I will lose a day off, and spent massive hours writing to them, so If I win I will try to claim - however I am not focusing on that that the moment. Let me read the Small Claim? one you suggested first.

The gladstone one i mentioned is this:

It's OK but we've had more since, written in 2017.

Read the Small Claim? section of the NEWBIES thread first.
