it is UK parking solutions and on the BPA approved operators website they are down as T R Luckins Limited t/a UK Parking solutions.
and NTK states that TNC parking services have obtained my details from DVLA using a "reasonabl cause request"
can i find out from dvla when my details were given out?0 -

UKPS and TNC are listed by the BPA as ATA members , however TNC seemed to have circumnavigated the v888/3 stipulation fo max cuttoff of supplied data (6 mths) by pretending they are a non ATA and using v888/2 and also claiming the registered keeper is liable
if you contact the DVLA , one of Mr dunfords assistants Greg.Evans@dvla.gsi.gov.uk , with a copy of the NTK , clearly showing that TNC have contacted the DVLA for info , as why they have circumnavigated the rules by stating their debt collectors info and not using the correct form as they are in a ATA, and within the correct period
G Evens is looking into several cases regarding misuse of the DVLA database by TNC0 -

only members of a recognised ATA are allowed to get data in regard to parking on private land , but they seem to have mislead you by stating the data is required for another reason.

Im shocked that they go to such extents !! i thought it was just a case of altering the dates on letter/postage date a little
i will write that email now and attach a photograph of the notice to keeper
i take it in the reply they should advise me as to when the infomation was requested aswell?0 -
well this chap is looking into TNCs actions , with the PPC you are dealing with and others
only companies that are in a ATA (IPC or BPA) can get details for parking charges and there is a set time limit , TNC are in the debt collectors ATA and the BPA , so they should state they are BPA and used the allowed time , they are not , they are getting info as a debt collector (not allowed for private parking) at any time , possably upto 6 yrs??

very interesting to know but at the same time worrying that they can so easily bend the rules.
I have sent the email with pic of NTK and will post a reply as soon as i get one.
So for now I sit tight and wait on the non keeper liability appeal . (ive checked the website now and they have transferred it to "on hold" status.
so going by what you say, TNC are guilty of breaching the rules. what is the likely implication? if it goes to POPLA , another appeal point or can they get into more trouble now having done this?0 -
the DVLA and BPA could sanction TNC , to a point of removing ATA access , also once "flagged" by the DVLA , they would look at every request and ask why?
if its proved that UKPS did not ask for data wittin the correct period , they cannot use keeper liabilty ,0 -
ok,
but i though that because the notice to driver was on 01/07/16 and the NTK was received 19/01/17 (with proof as the date stated on the NTK is 12/01/17 and i have the envelope with the date stamp of 17/01/17 and TNC company logo stamped aswell. therefore way over 56 days, there is no registered keeper liability anyway?0
