    note that wording , the car park seems to be within 20 ft of reception , PE have cameras at the enterance and exit recording time you pass those NOT the time you parked for , also the BPA stipulate a 10 min grace period on entry and "sufficient time" to leave ,, so that could easily take the PE (accepted time) + the BPA reccomendations to a figure exceeding 105-110 mins , do you think on that date (second occassion ) that it took you 25-30 mins to leave the docs surgury and leave the site?

    only when you have sight of a copy NTK can you see the "timed" entry/exit of the car park


    PE have fluffed this , they wont back down they will not do court , just send letters in a hope you will give in

    let them show thier evidence

    I have no clue how long I was there. Out of both appointments I would say it was the first one that was over 90 mins as I had two appointments with one being 60 mins..... they said for that one I just owe money for not putting my reg in at all as I didn't know PE existed!

    Hmmm saying that when I think about it, the manager said that I entered my reg correctly on BOTH occasions! For the first ticket I didn't enter it at all! I didn't know I needed to and that's why I got the ticket!!!!

    but , the receptionist has said that was cancelled ? , yet Pe say they wrote to you , but yet the website says "We have an agreement with Parking Eye that we will ask for the first fine for each vehicle/patient to be cancelled and I believe this has already been the case for yourself."

    Tell the Clinic by email (no phone calls) you have been advised that the parking regime is against Government Policy. As such, they have allowed a third party to obtain your data without 'reasonable cause' which is unlawful & aggravated by the fact that these are NHS patients being pursued contrary to (well known since 2013) Dept for Health policy about car parking enforcement, a matter for which the NHS signatory remains liable at all times, including liability for the conduct of the company they use.

    They have breached the DPA Principles and you will be complaining to the Information Commissioner this week, as well as seeking help from the EHRC.

    To expect you to pay for a Solicitor is wholly unreasonable and by the way, you have now complained to your MP and they will be hearing from them.

    I've emailed her. We shall see if I hear anything back!! I'm guessing I won't as she doesn't actually know what she's talking about. Her manager tells her what to do so maybe it's him I need to email?

    No it was PE who said it was cancelled over the phone shortly after my worker wrote to them back in 2015

    so why are they setting the debt company" on your back even the receptionist confirmed it , even their website says they will do this

    You need to know that even if PE send photos of the car being on site over 90 minutes, you do not pay. You are not liable to make payment for a regime that is disallowed in NHS car parks, this is the fault of PE (who know exactly what the NHS policy says, but put their own twist on it) and the Clinic (who appear to have trusted PE and not read the Dept for Health policy). That is not your fault.

    Even if PE waive one, you do not pay the other.

    This is something the Clinic and PE should be sued for and a counter-claim will be warranted, if they try suing you.

    I'm not going to pay. No way! Especially now I have learnt all I have and got a better understanding of what's going on. Even down to the threat letters, one min telling me it's the final warning before court then in the next breath a reduced fine!!

    end of the day CM , they have brought in house debt collection in , when normally its CC within 6-9 mths , so there is a reason for not going to CC

    It's all because I didn't follow the proper procedures and timeframes. They fail to understand that when I am unwell I don't care about my own life never mind threats from a parking company when I'm visiting my surgery in crisis. It's hard to get out of bed when I'm unwell but I was expected to fill out letters and go post them at the post box? Not very practical if you act me. It should take simple confirmation from the surgery that I had permission to be there and that should have been it'no matter when I responded

    This is why ParkingEye should not be let loose near vulnerable patients.

    The point is, how would you know you could complain to the Clinic and get these cancelled, no sign tells anyone that and indeed they had on their website some old pack of lies saying they could not intervene. OF COURSE THEY CAN!

    But at the end of the day the clinic should NEVER have signed that contract and - I have to say - I hope you sue them. If you do, we will help with your particulars of claim. We are only armchair lawyers but we do know what is and is not allowed in NHS Car parks, in terms of parking enforcement (not this regime) and we know what is allowed under the KADOE contract with the DVLA.

    An ICO complaint will assist, they can be done online but you would need help to explain the important points the ICO will need to know.
