Hi all,
First post on here, but I have been following the thread on HUKD (http://www.hotukdeals.com/forums/showthread.php?p=1104185) for a while now and have also been stung by this Littlewoods scam... They tried to rescind 2 vouchers from me, but fortunately, Derbyshire TS backed me up and got them to climb down. However, quite a few people appear to be getting nowhere with TS, which is a bit strange, but there you go.
I think the only way we can really hurt these scam artists is to mount a structured campaign against them. Instead of everyone who has been affected filing their own claims, I believe it would be far more effective and hurt LW a lot more if we were to club together and launch a joint suit against them. The negative publicity alone would cost them far more than the cost of paying out for the vouchers...
In order to do this, we would need >200 people to pledge their support as any claims less than 5k are dealt with at a local level in the Small Claims courts across the land. Any takers?

MCOL time I think, just need to work out the wording of the claim
I'd start with:
Dear Ms Jones,
Further to your letter dated <date>.
I am extremely offended at your implication that I in some way made a misrepresentation by using the code currently in dispute. Having reviewed your own terms and conditions prior to ordering, there is no onus on myself to perform any verification whatsoever in relation to any promotional codes used.
Given that many retailers use such codes to attract customers without limitations on their use, there is no way for the customer to identify a valid code without trying it to see if it works. Additionally, clause 2.3 of your terms and conditions clearly states that acceptance of my order is subject to Littlewoods verifying that the codes are valid for my order. Therefore, any responsibility for verifying the validity of such codes lies with Littlewoods, not the customer.
By failing to perform the contracted validation checks prior to accepting my order, Littlewoods are quite clearly in breach of contract in this matter, and you attempt to claim additional funds after conclusion of the contract is unlawful.
I am not prepared to enter into prolonged discussion in this matter. Therefore, unless I receive a satisfactory response within 14 days, I will commence proceedings through the County Court without further notice, to obtain a declaration that no debt exists. Please be aware that any costs in doing so will be claimed from Littlewoods.
I look forward to your response in this matter.0 -
I have suffered the same. Accidently used the code twice having found it on here. over a month after using the codes I recieved a letter saying I owed £50. I tried to contact them nd refund the clothing I had bought as I hadnt used it, but they said I was out of the 28 day refund agreement, so I had no choice but to pay the full £50, plus an additional £12 that was accrued because of time wasted trying to talk to Littlewoods.
If anyone can see a way for me to claim back my money then I would be really grateful
Many thanks
Don't panic. Despite what they say about possession being 9/10ths of the law, the rules change when someone claims a debt exists. Generally, the person claiming to be owed money is the one who gets to pull all the strings in terms of enforcing that debt. Before, LW were saying you owed them money. Now, the tables are turned. So you start with this:
Dear <person who signed the last enforcement letter to you>,
I refer you to my account #number, and my recent payment of <amount> in relation to this account.
I am writing to advise you that, while I have made payment in full in order to mitigate against additional fees on the account, I am disputing this payment. My reasons for doing so are as follows:
On <date> I placed order reference <ref> with you, for a total cost of <price>. I used a promotional code for £25 in part payment of this order. According to clause 2.3 of your terms and conditions of sale, acceptance of my order is subject to Littlewoods confirming that my code is valid. Clause 2.2 of those same terms and conditions confirms that acceptance of my order takes place at the point of despatch.
Littlewoods confirmed that my order was acceptable, including any promotional codes, by dispatching the goods. You further confirmed that you had completed your contractual obligations in validating this code, by refunding £25 to my <account/card> on <date>.
As such, I consider your claim that the promotional code used was invalid to be entirely without merit. I require a full refund of <amount>, to cover <itemise voucher + addiitonal fees here>. I also require that the voucher already accepted as payment by Littlewoods be re-applied to my account.
Please be advised that I have no interest in entering into lengthy correspondence regarding this issue. As such, if I do not receive a full refund, along with confirmation that my account is in order, within 14 days of the date of this letter, I will initiate proceedings through the County Court without further notice.
I look forward to your satisfactory response in this matter.
Yours Sincerely,

I recieved another statement from them today having refused to pay.
I have told them i am disputing it and the statement is still asking for £25 and has no extra charges added to it.0 -
First of all i would just like to say that, although i use both sites, recently i have been mainly using HotUkDeals. This is now going to change because i think it is clear from using their site that the site is being run to make money, most probably from the links to deals that are posted, this means the operaters of the site have vested interests and they don't really want to ban retailers from their site because it means less money for them.
I like many others have been stung by Littlewoods and i now owe £37 which i think i may have to pay now because i don't want it to go up each week and it seems that Littlewoods even has the backing of the BBC now which i thought was a public service provider.
I was just wondering if anyone knows Martins opinion on this matter ?
If he thinks Littlewoods have acted incorrectly is there anything he could do to help us ?
Now that this story has made the BBC news maybe Martin could be our savour and come to the rescue !
I have seen him on the TV and heard him on the radio many times and he seems to know pretty much everything!Watch the pennies and the pounds will look after themselves0 -
Well I watch HUKD as well and was interested to see a legal challenge is being organised.
Dojn't know if it is going to help me as to be honest I have little enough time on my hands with my twin girls as it is. But as I still got 10 days to pay will be watching with interest.
Legal Challenge being organised here if you are interested/can help/can spread the word.

Ive spoken to Martin by PM and hes not really had time to look into it and i dont think he will.
i can understand him not wanting to get to involved.
We all take a chance and sometimes it pays off and sometimes it doesnt.
Having said that i'll be damned if Littlewoods are getting a penny out of me, well not until the very last second.0 -
Check your online statement again, because I initially wrote to them to say that I would not be paying, then received a letter to say that the £25 was still payable. However, I checked my online account today which gives the balance payable at £0.00 and states that the £25.00 was credited on 15 October.0
