littlewoods: only use codes that are sent to you!

  • I used this discount with them some time ago and they have yet to take anything back out of my account.

    Would it still be possible for them to take the discount money back if I cancel my account with them?

    Help much appreciated, cheers.

    I think I may have a partial solution to shaft Littlewoods over this. Just got to do a bit more digging about to check a few facts first.

    Here it goes.

    Apparently credit agreements taken out after April 2007 fall under the jurisdiction of the Fiancial Services Ombudsman (FSO) (http://www.financial-ombudsman.org.uk). So put in a formal complaint to Littlewoods, GUS etc and ask them to deal with it according to guidelines set by the FSA. They will send you a final decision letter (no doubt they will not back down). So download the complaint form from the FSO web site and state your case.

    It will cost Littlewoods several hundred pounds in fees as soon as the FSO get involved. There is no cost to the consumer. The FSO are usually quite good when dealing with such matters and may find in your favour. If not then at least you will have the pleasure of knowing it has cost Littlewoods several hundred pounds in fees.

    I've had my account with Littlewoods for about 2 years so does that mean I wouldn't be covered by this. Or would I be covered because the transaction took place after April 2007?

    Phone them on 020 7964 1000 and ask if your agreement falls under their jurisdiction.

    I would have found that a very difficult sentence to type !! ;)

    Remember these people are just doing a job none of whom are legally trained. I have found if your are polite courteous you can get more from them, and in fact, have received an email today stating the following:

    Thank you for your recent email.

    On checking your account I find the email I sent to you on 16.10.07 was sent in error. The £25.00 voucher used has already been applied to your next statement.You will be able to view this on you're my account facility online in your statement section. We have not applied a debit to your account at any time.

    On the rare occasions when errors arise we do make it a priority to make amend for any inconvenience caused.

    Please accept my apologies for the inconvenience caused.

  • Success it seams, I recieved this letter this morning dated 4th October as is in reply to my 2nd recorded letter to them:

    Thank you for your communication regarding the 25.00 debit adjustment.

    Please accept my apologies for any inconvenience caused.

    Your account has been credited with 25.00

    The adjustment will show on a future statement.

    I hope you will reconsider your decision to close your account.

    I am not a credit customer and never bought from them before, hopefully thats the end of the matter, and if they think i will be leaving my account open they got another thing coming.:beer: :T
  • I dont want to rock the boat here or cause a huge arguement but I just cant see why you are all moaning about how 'bad' Littlewoods is since you've all been using codes not sent to you and would carry on doing so if you hadnt been caught out.

    If its only £25 to repay and not probably £xxxs that you've saved you should all count yourselves lucky and hope all the other catalogues dont follow suit. :confused:

    No problem with repayment as long as they follow their own terms and conditions. If they want to play silly !!!!!!s by trying to twist their own terms and conditions, then I will go along with them and make the whole thing last a few extra months (and cost them £££ by taking this matter further). If it was a small retailer or sole trader then I would not have even bothered using the code. For years these catalogue companies have shafted people and it is time they got a taste of their own medicine.

    Who cares if the Dave and Freddie Barclay take a smaller dividend this year ?
  • been following this thread and thanks to all of you with advice etc

    however i got another letter today from them and they are still not backing down and still reiterating their terms and conditions yet ignoring the ones that they have breached

    not sure what to do now
  • 2.3 Where you have redeemed a promotional code or any other offer ("a Code") against your order, acceptance of this order is subject to our verifying that the Code has been issued to you personally, that you comply with all the terms of the offer and qualify for the Code. In the event that the Code has not been issued to you for your personal use or you do not qualify for the offer, the price of the order will be adjusted notwithstanding any email or other confirmation that you receive.

    2.2 When you submit an order to us on our website you will receive a 'bounce back' confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery.

    3.2 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.


    2.3 does state that acceptance of the order is subject to verification. However 2.2 states that the order is deemed to have been accepted by Littlewoods once the goods have been dispatched, ergo Littlewoods have accepted the validity of the code and formed the contract by dispatching the goods. Furthermore 3.2 is stating that should they have discovered a pricing error prior to the order being accepted then there would have been the opportunity available to either accept the correct price or to cancel the order completely, this has not happened until after the event.

    Going by Littlewoods' own T&C they cannot come back over six weeks later and try to demand more money.
