Thanks losgiganteskid for your reply. You mention in one of your earlier posts that according to Littlewoods t&cs they are not allowed to impose late charges or transfer you to a credit account if you paid by credit card. I would appreciate if you could help point me to which clauses in the t&cs address this issue. I'm too dumb and can't find it!

OK - if you look at the t's & c's you will see that there are two sets. One appertaining to t's&c's that refer to the website and another set that appertain where a credit account has been applied for.
Under the latter set of t's and c's there is provision for a default charge to be added if an instalment is not paid ontime (and under other circumstances).
There are two issues here - one being Littlewoods seeking return of the monetary value of the code after the order has been accepted and sent and the other is where a default charge has been applied to an "account" for example a £12 fee where the £25 code recovery amount has not been paid within a certain time.
Those persons who paid by credit/debit card cannot have a "late/missed default charge" added under the terms of the credit account t's and c's 'cos they don't have a credit account. It appears Littlewoods don't have any other system in place for late or non-payers so it trips by default in to their statement/account facility and the computer auto kicks in with the default charge.0 -
I have emailed all my catalouge accounts that are owned by littlewoods, asking them to close my accounts, I have just had replies, saying they are sorry to see me go, but are closing my accounts, oviously you can't do this on the accounts where they say you owe money, but I told them I was appalled at the treatment I had received recently and would not stand for it. If we all do this, they will see the effect their behaviour is having.

Your agreement is governed by the laws of England and Wales. All communications will be in English. Orders on credit cannot be accepted from anyone under 18 years of age. When you have a Credit Account with us we will ask you to sign a credit agreement
I have not signed any credit agreement as i paid by debit card so i cant see they can legally charge me any of the late payment charges.

I used a £10 voucher and paid by debit card, I can not have a credit account as I am in a DMP, and part of my T&C of that is that I can not obtain any further credit as it will deem my DMP agreement null and void. If they do decide to hit the £10 voucher users, what will they do? can they charge it to my debit card or will the then open a credit account and add a charge to that and send me a statement ???
I am worried because I do not what anything to affect my DMP agreement!! and I can't really email littlewoods and ask them.....
My order was confirmed twice by email, once when I placed it and secondly when they informed me that they goods were going to be delivered, both emails state the price less the discount voucher. I have kept both of these emails.
I have never ordered from littlewoods before (neither will I again after reading here what's happened to others!!!)
Has anyone had a card charged after the event ??

My £25 has been refunded. Am still annoyed seeing as i didnt owe it in the first place! Hope everyone else gets theres sorted out.'They only had one cow!'0

I've been going through all this with Littlewoods too....
I recently sent this reply to them and am awaiting a response:
Dear Emma,
To be honest you could have a statement from the Pope explaining he feels that what you have done is ok.
In my book it's not and everybody I've spoken to agrees. Let's see what the public think.
I'll be drafting an article tomorrow, first for the IT press because I think what you are doing has important implications for online trading standards.
Next I'll see if any of the national press are interested - who knows they may be, Littlewoods don't exactly have a great reputation.
And then possibly some watchdog television and Radio programs.
The fact you put no measures in place to stop people redeeming this voucher number implicates you in my opinion - there is nothing stopping you using this as a deliberate tactic to entice people to make purchases and then hit them 2 months down the line.
You know damn well that 99% of customers will not read the full Terms & Conditions, especially when ordering from a well known company like Littlewoods.
If the offer was restricted to a select few then your online ordering system should have stopped just anyone using it.
I cannot believe your systems didn't alert you to this immediately.
I honestly don't care that much about the £25. I am fortunate enough to be able to afford to pay you the money. But I won't. At least not until I absolutely have to by which time I will cost you far, far more than £25 in negative publicity.0 -
