To the OP - if you want to PM me with a breakdown of the assessment, I can tell you straight away what type of assessment this is - whether it is an Interim Maintenance Assessment or not. If it is, then it is quite simple in theory as you would need to provide the information that the CSA need to convert the assessment to a full maintenance assessment. If it is already a full maintenance assessment already, you do need to check that they have correctly taken into account any children you have - but I guess this is a CS1 case and if you haven't told them of your babies, they can't have done this and won't be able to do so until they have been notified. The rent or morgage costs need to be checked.
It DOES sound like an Interim assessment for the arrears to be so high, but I would have thought that they would have already imposed a DEO by now, unless your hubby has only recently started working or has changed jobs a lot?0 -
WOW! I cant believe that my post has created all of this!
Firstly for those of you that are dissing the NACSA, I have already had several emails from the person who is helping with my partners case and it has been worth the £40 aready! And as for getting advice via this site, i use this site al the time for various things,( and it is fab!) but no one offered any specific advice other than chair ( and kellogs later ,ty.)
£40 is a lot of money but for people like us who are in the middle ground of not being on benefits and therefore not qualifying for legal aid, but only making enough to cover bills, can not afford to use a solicitor, the service offered by NACSA is invaluable! I dont have a clue where to start with geting my partners mess sorted out.
Kellogs... my partner has never had an assessment, he has never had to fill out anything ( as far as he can remember) with all of his details, so this is why we wondered how they had come to that figure. And yes he has changd jobs quite a lot over the past years. Mainly , originally cause it was the nature of the job being a driver but now he works as a prison officer and has been there for about 18 months.
One question i did think of in addition, he received a pension from when he used to be in the firebrigade, he got early retirement through ill health. Its about £350 a month, this is in addition to his salary from work. Can they take this into consideration as well.

oh i just remembered,,,his ex wife has always been on benefits, but she was married at some point ( to husband number two ( she is now on number 3...her mother must be so proud!) ) and he was working ( in the forces) so im not sure whether any claim would have been closed down so i have no idea whether my partner will be CS1 or 2! We have got some letters prepared to send ( by special delivery) on Monday to them requesting the info.:EasterBun ...what more do I need to say?!

i just thought of another question ( sorry) my partners case is being handled by a CSA office in Belfast!!! is that right? I know in this day and age of IT we can be anywhere and still work but i just thought it was odd that it was so far away! Is anyone else with this office?:EasterBun ...what more do I need to say?!

This country is a Joke.....
I decided to go on entitled2. last night, its a site we use at work and its generally fairly accurate in giving people a good idea of what benefits they should be getting...
so here is the scenario ... we ( as a couple) are currently sturggling to make ends meet, we arent entitled to any benefits other than the basic £500 odd a year from theWTC a year) when the maintenance kicks in we are going to be, as a maximum, on the breadline ( and because I am a DFW I have already cut spnditure down as much as is possible),when the arrears kick we will NOT in any shape or form be able to pay the mortgage.... we will have to sell up, my children will lose their home and their Dad will more than likely have to give up work .... because the CSA can take 40% of his wages, it wouldnt even cover the cost of his petrol and childcare.....natural scenario from this is that we evntually split up under the strain, he gets depression again and ends up in hospital again..kids lose their dad!
Heres the second scenario.... we split up now, sell the house and declare myself as a single mum paying out approx £200 a week in child care....
ontop of my salary of £22k ( which brings me home about £16K) I will be entitled to benefits that will bring my take home money up to the grand sum of £30k !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! yes i would be paying out a large chunk of that to childcare but that is just ridiculous....I wold still be better off financially and able to give our kids a decent standard of life...
I know people will say oh but its better that you sick together through this , and the children are better off with both parents,,,, but not when both parents cant afford to put a roof over their head, feed them, and their Daddy ends up having another nevous breakdown!
this country is crazy, it does plenty to suppot the single mu and from what I can see absolutely nothing to support the family and if you happen to be in the middle in regard to wages, you have had it.... i wold better off to be a dole dosser like her and live off the state.

My husband is with Belfast and had a letter from Plymouth telling him he had to pay arrears totalling £500 per month till next Dec.
A week before he had a letter from Belfast stating he had nearly caught up with arrears (which the csa caused) and had 1 more payment before he reverted back to his regular calculated amount.
Why Plymouth got involved I'll never know but There is never any letter apologising, only money demands. If someone wasn't ontop of their payments and knew exactly what they were paying, it could send them over the top.0 -
I know there wil prob be lots of PWC out there who will have strong opinions about the fact he hasnt paid any maintennace but there is a whole big story behind that and im asking for help rather than opinions.The little girl wants to come with us. She is nearly 12 and ive been told that once she is, the court has to take her wishes into consideration, so we may be able to do something about that.God, Im not a nasty person but for the first time in my life, I wish that damn woman dead. she doesnt deserve the beautiful children that she was blessed with. Sorry ( for being horrible but I mean it so I cant take it back!)

No, they don't look at your incomings and outgoings at all. They only look at the incomings of the NRP and they include ANY child tax credits in the household, so even if the new partner gets them, it is counted as income of the NRP. ON top of this, if the NRP partner earns less than the NRP and they get working tax credits, that is also counted as income for the NRP. So whilst it may look initially like they take a flat % of the NRP net income, some forget to add these things on.
You are probably looking at an old CS1 case, where they took mortgage or rent into account and gave a personal allowance equal to that of income support, which often led to nil assessments. In your case you could have closed the case after March 2003, waited for 13 weeks and then reapplied under the new rules which give no such allowances.0 -

How dare you comment when you know very little about our situation..and as for the child,,she knows exactly what her other is like because she has found out herself, when her mother has consistently lied to her, taken her away from her Daddy and lied to her about that, not informed anyone of where they were going,changed her name without gaining the permission and lied in a court of law to say that she hadnt depsite the fact that she was registered at the schools as it and had her new name written in every piece of clothing...lied about things that happened in the past when she was younger only for the little girl to remember herself and realise what she had been told was false.

This country allows children to be kept in families that dont care for them properly, have no work ethics and teach the children that if something gets broken then its okay cause the state will buy the another one, their job is playing the system and they do it so well! and if you dont thinnk this kind of stuff really goes on then you arent living in the real world.infact if I didnt know any better i would say you are a social worker!...the sort of person who thinks its okay for a 12 year old to be held upagainst a wall by a grown man and threatened with a fist in her face. ~unbelieveable....
so if you think that i can stand by and watch anything like that go on,,,and say ' oh its okay', you either dont have a heart or are stupid.
I was warned about this kind of response on this forum but i hoped that my previous experience of the site would prevail and i would receive balanced responses So unless you have something senseable to say, please dont bother.
