    the statement that the KEEPER (hubby) was not the driver and can prove it in any future court case can be added , but definitely nothing else

    EXCEL will try to hold the KEEPER liable for the charge anyway , regardless, but as they do not follow the rules under POFA2012 and as the keeper will not be naming the driver and they can go "whistle dixie" then it would be down to them to prove their case in court

    so the less said , the better , because if they fail to follow the laws and rules, they cannot make a successful claim against the keeper (the person they wrote to) and they have no idea who the driver was as they have no proof , nothing at all (which is why they wrote to the RK in the first place)

    How did this get to 63 posts?
    (Is everyone in agreement that if he appeals to Excel telling the truth (that it was his wife, his disabled MIL, a misunderstanding over a BB, and a till malfunction in Toys R Us) that it will get us nowhere?)

    Dozens of posts back (ahem, post #14, in what seems like another lifetime) I told you the keeper (husband) should do exactly that, to the landowner, whilst also sending the IPC template to the parking firm. A two pronged attack from the keeper.

    Not sure why you have gone round in so many circles that the advice to email Adam and Nicola at the Peel Centre, saying the entire family will never come through their retailer doors again, appears to have been forgotten, or not followed up (I see they said they are 'investigating'). So follow them up and say how distressing this is for the entire family to be blamed and charged for ToysRUs' own till technology failure causing a delay.

    It's the only way to cancel it. I think this one will be cancelled by the Peel Centre.

    Don't let OH say who was driving (he can say he wasn't, but do not name the driver). Please stop looking at the flippin' discount bribe deadline. It's discounted to zero when it is cancelled.

  • Great news everyone: I got an email back from Peel Holdings saying that they would cancel the ticket.

    I replied thanking them asking if there was anything else we needed to do at our end (i.e. contact Excel) - but he said not. He said to just email him again should I get any further correspondence from Excel.

    However, I'm still panicking. Do you think I need to do anything further?

    Wow, great bit of news. Excel *should* write to confirm cancellation, whether they will or not, who knows. ParkingEye, for example, are pretty good at confirming cancellations, but we see too few such cases for Excel, we aren't sure of their modus op in this regard.

    I don't think you need do anything now, other than retain that gold dust of an email from Peel Holdings. It's an early Christmas present!
