  • Or, should I say none of this and reply using the example in the sticky thread which refers to landowners and insufficient signage?

you could point this out and try to get TOYS R US to get it cancelled , they may well manage it , especially as a disabled person under the EA2010 was in the vehicle

but its a pay and display car park, where a ticket must be purchased within 15 minutes , no exceptions apart from the red bays at KFC , which have an extra 15 minutes on top

yes I understand what happened and why

as I said , its not a fine , no private company can fine you

but they may well win in court

if you pay up and make sure its by cheque or bank transfer, keep a record for 6 years , as they have 6 years to try a court case

a judge may well find in your favour if you can prove the pcn was paid (parking charge , ie:- parking invoice which was the NTK you received)

please note that the BB is not a "catch all" method to park in any disabled bay , any parking rules or road markings should be observed and checked

you wont find many places where you can just park regardless with a BB on show , you must always check the signs , even on crown point north which is free for 4 hours , or tameside hospital (or tameside council car parks) where payment is required and you get an extra hour parking time on top

there are a few free disabled bays at Stepping Hill Hospital where you can do what you did , but on the main car park you may have to pay anyway

your error is assuming that her BB protects your car in any disabled bay , anywhere , anytime , it doesnt , sorry

their signage is woefully deficient , and has been for years despite being changed several times , hence why some people win in court , but you missed the signs at the entrance/exit (which they deliberately put there as you cannot stop to read them) and you didnt check to see what it said for disabled BB holders either

check that parking prankster map, it shows half the car park with bad signage (there are 2 car parks there , adding to the confusion)

the question is , what do the signs say when viewd from those disabled bays ? they should be prominent and set out the terms on which a disabled person can park there , preferably without getting out of the vehicle

try and get toys r us onboard, you may save the day , especially if you mention the EA2010 and the BB

I feel sick with worry. It was a genuine error. Neither of us saw any signs, we parked in a disabled bay and displayed a blue badge (I realise NOW that that makes no difference and that the BB rules don't apply in private car parks).

If I write saying all this, and the fact that yes, we were 31 minutes when we should have in fact taken less than 10 minutes but the tills in Toys r Us stopped working - there were literally dozens and dozens of people stood waiting in the queues inside the store while they got the tills back up and running (luckily, we were at the front of the queue!)

Oh calm down please and read the NEWBIES thread. the first piece of advice there is to complain. We had a thread like this just the other day so why do so many new posters not read other threads first? Look:

And here's one from 3 weeks ago where it's already been cancelled - yes, by the Peel Centre:

If I say all of this will it make a jot of difference
No, but it might if you say it to Toys R Us and Adam Jolley/Nicola Dearden of the Peel Centre. Especially re the till malfunction in ToysRus. What makes you think YOU are liable?
or should I just pay the fine?
NO. If we had a pound for every time we say 'it's is not a fine' we'd be rich. I don't think anyone should feel proud of weakly paying up 'for an easy life' because that funds this operation, YOU would be supporting & funding the next PCNs against more worrying victims who might be naive enough to pay.

STOP. Please get a grip - it is not a fine.

Read the advice. Tell us when it's cancelled and forget the idea of supporting the rip-off by funding them.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As above, it is not a fine.

You are a mug if you pay it, ad will be funding the scammers who will go on to scam people even more vulnerable.

Send the IPV template from the NEWBIES thread as advised. Copy and paste and send.

Ignore debt collector letters. The NEWBIES tells you why it is safe to do so.

  • I am trying to read the NEWBIES thread but I can't see what the "IPV" template is. I've done a search on that thread for IPV and can't find it. I want to appeal in the first instance (nothing ventured, nothing gained) but the way I feel about the whole mess is that I would rather just pay it and forget about it :(

Look for the IPC template letter (not ipv)
  • Ah, I've just realised Fruitcake that you meant IPC. Do I need to copy it word for word? Should I include anything about the blue badge or enclose a receipt of purchased goods as proof of patronage?

    Just send as it is,
  • And do I send it to the Excel Parking address on the PCN?

Don't you have a NTK? You should be sending this letter in reply to the NTK.
