I have (addressed to my husband, the registered keeper) a "Parking Charge Notice". It says "Charge now Payable" and has the contravention date/time/duration of stay. It was sent by Excel Parking. Is this the same as an NTK?0 -

Make sure he replies, (not you), and doesn't reveal the driver. (There's no rush, and you do know it will be rejected - it's just an exercise so that they cannot say (in a future court case) you ignored them.)0 -

I have emailed the Peel Centre and I have emailed Toys R Us head office. Both have already replied this morning to say that they are investigating the matter...0 -
Throughout your thread you have been advised about the possibility of court action.
There is always the possibility that these charges end up with a court claim - they have 6 years to take legal action.
No point capitulating now.
Especially as you are still awaiting the retailers response!0 -

If it's only a box-ticking exercise to show I didn't ignore them, can I not then reply stating my reasons as to why we didn't buy a ticket (blue badge/only thought it would be a 5 minute trip inside to collect a pre-reserved item but the tills were down)? Will that not just serve the same purpose? Is the IPC template for people who had no valid reason not to buy a ticket?
Also, the PCN states that if an appeal is made within 14 days but rejected, the lower fine of £60 will still be payable. If I appeal AFTER 14 days £100 will be payable. To me, there is a BIG difference between £60 and £100. So I obviously need to send it soon-ish.0 -
As far as I'm concerned, I wont have the threat of court action hanging over me. I'd pay £60 right now just to have the whole thing over and done with and put it down as an expensive lesson.0

You don't have to take the advice here - but mitigation is irrelevant as far as these people are concerned!

The scammers love people who just pay up, better the £60 in your pocket than theirs but it's your choice.
Would you give £60 to a beggar in the street, the scammers are just begging you and it's a long way from court and no point in appealing to the IPC ..... they are just another sham

In the past 2 years and 9 months Excel have issued around 1/3rd of a million tickets (330,000). In that same time they have issued court proceedings in 155 cases.

Now do the math! Less than 0.05% of tickets get to a court stage.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
