eBay dispute - seller threatening small claims

  • Oh, I'm sorry but assumed you and the seller were in the UK. Is it you or the seller in Guernsey?

    That being said, if the item is under 2kg in weight, the label provided by Ebay would have been sufficient if it was a Royal Mail Tracked label.

    However, you did the right thing letting Ebay know . Was the £20 you paid for a tracked service?

    Thanks for your reply. I am in guernsey and the seller is in the UK. I think it is over 2kg weight but am not sure. The box is huge. I didn't pay to have it sent because I kind of resented being out of pocket so much for the sellers misleading listing. I contacted eBay instead and they told me they would put the case on hold for 5 days to give the seller time to provide me with the correct label (I don't understand how she can do that though). They said that if, at the end of the 5 days, the seller has not done that, then eBay will refund me and I can keep the item. But I don't want the item and feel a bit uneasy about the whole thing. I just want rid of the dress and a refund! Any suggestions? The eBay lady said that I shouldn't pay the postage, especially when it was so much and said it was the seller's responsibility! Any suggestions? I'm panicking again!

    That's normal procedure as far as ebay are concerned. If the seller doesn't provide a prepaid returns label then you will be refunded in full.

    If this does happen, contact ebay again and get confirmation if the refund came from the sellers account of if they (ebay) made a refund out of their own money. (this does happen occasionally).
    If the refund was from the seller, send them a message informing them that you have their dress and once they have sent you enough money to cover the tracked return, you will send them the dress.
    Make sure that you ask for the payment to be sent by a Paypal gift payment so that it can't be reclaimed at a later date.

  • I don't use the APP, can you look at the case using a phone but with a browser rather than the APP? How did you get the first label?

    So eBay have issued me with a full refund and told me that I can do what I want with the dress; give it to charity, bin it, sell it. I don't want to keep it but at the same time, it is someone's wedding dress and holds sentimental value to them. I am really upset by the seller as she has accused me of causing the damage and threatened to take me to court (which I am still scared she might do) however I thought I would contact her through eBay and explain that eBay has refunded me and why and reiterate that once she has provided me with a returns label, I will return the dress. Do you think that this is the best idea? Many thanks.

    Yes I think that is the right approach. keep it simple and polite, just say you have your refund and the dress will be available for returning for a period of 1 month, as long as seller provides a fully tracked pre paid label. Say that after that time you will offer the dress to a charity as you will assume the seller does not want it back.

    Good result - well done!

    I would send a short message quoting ebay's advice to dispose of it, ask them if they would like to send a label to return the dress and tell them that it will be disposed of in a week's time.

    Thank you. Well I have sent a message. I explained that eBay had refunded me, that the dress was damaged and not as described, that I was upset by her allegations that I had damaged the dress and it was still in exactly the same condition as it was when I received it and that eBay had advised to give it to charity or get rid of it but that I would keep it until I had heard from her and return it once she had provided a label. I have tried to be polite at all times with her and act decently. We will see what happens. I don't feel relieved yet as I keep worrying that a court summons will come through the door. Or that she will start harassing my fianc! at work as that is who the dress was delivered to.
