eBay dispute - seller threatening small claims

I got a reply from her telling me that she doesn't know how to send a label and so I should just write her address on a bit of paper and stick it on the box. I know I can't do that because it needs to be tracked. I think she should at least be making the effort to find out how to facilitate a return. eBay have given her time to do this. Am I expecting too much? She sent a faulty dress, threatened me with court and now it's me trying to resolve it and making the effort to try and get the dress back to her.0

You could try one more message and then ignore her. Perhaps say you are happy to stick her address on the parcel but fully tracked post will cost xxxx and she will need to send you that by PayPal to enable you to send it , if she doesn't want to do that then you assume she is happy for you to dispose of the dress.
Then ignore her.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Thanks. I will do. Another thing that someone mentioned is that I should check with eBay to see who refunded me. If it was from her account then to send the dress back once she has provided a label but if it came from eBay then she shouldn't get the dress back because she still has the money? Is this correct?0

Personally I wouldn't worry either way. Just give her time to either send a tracked label or the money for return and if not then donate the dress somewhere. You have done everything you need to do the ball I snow in her court and I would frankly stop worrying and not even bother responding any more.
She won't go to court, but on the miniscule chance she is stupid enough to try it just make sure you keep copies of all your emails .I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I would just get a Royal Mail special delivery quote to have it returned (saves waiting in all day for courier to collect!) and ask her to pay the money to you then you will return it.
Or she can work out how to send a returns label.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Hi. So I have sent messages to the seller regarding a returns label however she has not responded. Today I have been contacted by the BBC because she has contacted them with a complaint about eBay and me and they want my comments on it. I don't know whether to ignore them or defend the fact that I have done nothing wrong. This seller is completely unhinged and her threats are causing me no end of stress. I have contacted eBay however there was not much advice that they could give. Could anyone please provide some advice. Many thanks.0

It is the BBC JVS show that has contacted me.0

It is the BBC JVS show that has contacted me.
frankly I'm at a loss now, firstly though make sure it is a real contact and not seller being funny again.
I think that I would probably now write a statement, maybe even get a free legal consultation, or at least get someone to read it over. Then get I touch with the JVS and explain that you have a written account .
The statement should be brief and factual, this happened, eBay decided this, I have repeatedly attempted to get seller to arrange to get the dress back. Make sure you mention feeing harassed by the seller and explain that seller has had every opportunity to have item returned.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. It is a real email but the whole thing is absolutely ridiculous. The dress is in exactly the same condition as it was when I received it. The whole thing is completely stressing me out. Does anyone know what this show can do to people? I don't think I be using eBay again as it is just not worth all of this when it goes wrong!0

The shoe can't 'do' anything to people. It's a consumer right show - more likely they are interested in eBays approach to dealing with complaints from buyers rather than you. I think Soolin has given you good advice, give a short, factual, written statement and point out the many opportunities provided to have the item returned and the attitude of the seller. Then forget about it. If you are asked to speak on the show my suggestion would be to decline unless you are have some experience of being interviewed.0
