eBay dispute - seller threatening small claims

So I am really nervous. Tomorrow is the day that I can ask eBay to step in. Would really appreciate it if someone could please explain what the next steps are if eBay side with the buyer and the next steps if eBay sides with me. Also how long do eBay usually take to make a decision once they have been asked to step in? Thanks in advance.0

You will be able to ask Ebay to step in on day 8, but only when the exact time has passed. If the case was open at 1105am then you won't be able to escalate it until then, 1105am. They usually promise a result within 48 hours.
If Ebay rule in your favour, they will ask the seller to provide a returns label. If the seller doesn't, you may have to ask Ebay to provide one, alternatively they may provide it if the seller has already indicated they won't. Whatever the label, if the seller provides it, ensure it is a fully tracked label. Those supplied with eBay are usually Royal Mail Tracked (not Signed For but a proper Tracked service).
When you have the label you will be given a deadline by which you need to post the item. .
Take a note of the tracking number, enter it into the return and periodically check to see when the status changes to 'delivered'.
The seller is also given a deadline by which to refund. If that deadline passes without a refund, you may need to ask Ebay to action the refund
Try not to get ahead of yourself or to worry. Read the emails that eBay give you and take note of the returns deadline. If you need help, ask here.0 -

So... I escalated the case and eBay ruled in my favour! First hurdle over. Now I want to package this nightmare dress up and return it ASAP! Can anyone advise where I will find a returns label on the eBay app? Thank you!0

Ok so I have an email and I have found the label. So I really just print this and take it to the post office and I don't have to pay postage? When I go into the app though it still says that a case is open? Is this normal? Thanks0

The label should be a RMT label, can you upload a screenshot without the identifying bits? You should be fine but it is easier to confirm when we see what you have.

Wow what a liar that seller is, ebay would never have said that, not in a million years.
They will always take the side of the buyer in returns cases because it's always going to boil down to "he said/she said"
They can hardly take the side of the seller because they shouted the loudest, possibly denying a genuine buyer their rights.
The downside for sellers is that they can fall victim to dishonest buyers - but at least they can report those buyers for abuse of the returns system, and if ebay spot a pattern emerging on a particular buyer they can act.0 -
Thanks for your help. I won the bid and paid on Monday. She posted on the Tuesday and I received it on Thursday. It was posted to my boyfriend's work and he brought it home with him Thursday evening. I opened it about 6 and examined it. Found several tears and send her a text and photos of damage at 7:15. She responded asking me what I wanted to do. I had to go out to a work event and I explained this to her and said I would be in touch after the event. I sent her another message that night with more photos and describing the damage. On the Friday morning she said she would put £50 in my account to cover the repair but other than that I could return it and she would refund my money. I said I would look into postage costs as it is a huge box. I checked costs at the Post office Friday lunchtime and sent her another text but got no response. Sat morning I requested a return formally on eBay. She responded Monday morning to say she had contacted eBay and submitted video evidence of the dress before she posted it and eBay has said I would not win anything. She also said she had been to see her solicitor Monday morning, taking time off work. Her solicitor had advised that if eBay refund me then she should take me to small claims court. She said she would be claiming the cost of her solicitor, time off work and the cost of a professional repair to the dress for the damage I have caused to it whilst it has been in my possession. I think I can escalate the eBay claim on the 21st November. Please help!

Sorry but I am after more advice. So, I printed the label provided by eBay and took the item to the post office and they can't accept the label. Because guernsey is not UK (only British) the postage is slightly different. The quoted fee for posting it is £20! I begrudged paying this myself and contacted eBay and they have put the case on hold. The lady said that the seller has 5 days to provide me with a label that I can use (how can she provide that) and if at the end of the 5 days she hasn't, then eBay will refund me. It all sounds a bit strange. Is this normal? I really just want to get the dress back to the seller and forget about the whole nightmare (as long as the crazy seller doesn't start court proceedings against me!). Has anyone else experienced something similar and what was the outcome? Any help is appreciated!0
