eBay dispute - seller threatening small claims

    Just read what others have said and wait for ebay's decision. If you have been truthful then they will rule in your favour.

    If you send back the item using the pre-paid label ebay provide pack it well, take photos of the packaging etc and keep hold of the receipt, once you add the tracking numbers in on the item dispute then you will get your refund.

    This is how ebay works, the seller knows this and is trying to scare you, which is working.

    The seller will have to claim off the courier for the damage to the item themselves and not try and claim un-necessary expenses from you, assuming the item was not damaged by them.

    They will not need to instruct solicitors for a small claim track as you do not need them, they can not claim the damage from you as it was damaged in transit, they cannot claim time off work. Their recorse is off the courier.

    Thank you for everyone's advice. The item was def not damaged in transit. It is a wedding dress and the bottom of the dress at the back has several holes and tears in it, as if heels have been caught in the lace. I would like to belive that she just didn't notice them rather than she is being malicious but I don't know. She is adamant I have caused the damage and I know that I haven't. I haven't even tried the dress on because I saw the damage and contacted her immediately. She also said the only fault was a tiny dust mark that you couldn't really see and had to hunt for but the underskirt of the dress is all bobbly and worn. When I pointed this out, she said that the dress had not been dry cleaned and she never claimed it had been so I shouldn't expect it to be in that condition. I wasn't expecting it to be dry cleaned because she had said it was in excellent condition with no marks.

    Can anyone advise how long it takes to block someone on eBay? I realised that I have an expensive coin ending in a couple of hours. I'm probably being overly paranoid but I started to worry that the seller I am having a dispute with might do something untoward. I have now blocked her but was wondering if anyone knew how long it takes. I might not have left enough time! Many thanks.

  • You can't block her from contacting you if she's already been in contact, as the thread of responses is in her messages. The only thing you can do is not respond.

    Just let the Ebay case take it's course.

    The seller is trying to intimidate you into backing down. I don't believe for a minute that she has seen her solicitor (Mine is £240 per hour. There is no way the seller would spend that on an eBay case.). Her claims of proof etc are just hot air and simply don't stand up.

    Follow the good advice on this thread. Be reassured that you can get further help here each step of the way.

    Crikey, you do lead a charmed life. Most of us have gone throught this sort of thing regularly with eBay....
