Sounds like you have grounds to claim against the parking firm and the landowner then, for misuse of data. Not TNC, forget them, the parking firm and their client remain liable for misuse of data under the DPA. See Timothea's summary thread about DPA claims, you can serve revenge cold, get it right, take your time.

  • I am going down the same road. It was TNC who applied for my data from dvla but I go for the landowner and Autosec?

Good question. I would say yes, landowner and Autosec because TNC were merely the agent route to getting the data for the parking firm and Autosec's data controller remains liable for the actions of their agents. And their principal in the landowner contract also remains liable for the actions and data handling of its contractor parking firm.

Bargepole has posted an example of a LBCCC for pursuing firms AND landowners (or retailer/managing agents, basically this must be the party who contracted the PPC) jointly for data misuse. It's in spaceman8's successful court claim thread. Then a claim would follow and could be discussed on each individual thread.
