NTK 100+days late?

Earlier this year a relative was issued with a Parking Charge Notice by a local PPC while using my car.
A windscreen ticket was issued at the time and passed to me. I chose not to act upon it and over 100 days after the ticket-issue date a letter arrived at my home from a "Credit Solutions Company" acting on behalf of the PPC.
As far as I can tell the documentation etc is all correct.
Does anyone know how much of a factor is the long time lapse if I choose to appeal. Is it worth it?

  • Does the letter provide an option to appeal? Or is it a debt collector chasing up an alleged debt, on the basis that an NTK was sent out (but not received) and ignored?

    credit solutions is the debt collectong arm of a low life , so low I can,t remember

    Which PPC - and does the letter offer appeal, is it headed up 'Notice to Keeper', or what?

    The letter is headed: Parking Charge Notice and informs me that the charge "remains outstanding".
    There is a box inserted in the letter titled: Notice to Keeper or Hirer, with the details of the PCN and the contact details of the PPC, Autosec 28.
    It informs me that TNC Parking Services (the name at the top of the letter) do not accept appeals as they did not issue the PCN.
    They tell me that I can appeal to Autosec 28 and that if it is unsuccessful i will be given details of POPLA

    Use the blue text appeal from the NEWBIES FAQ sticky. Use as is - no changes, and as they have failed to meet the PoFA deadline and therefore cannot hold the keeper liable, give no indication as to who the driver might have been.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I woild suggest that this tin pot company (autosec) run by a ex clamper and thug, may not be able to afford court action (very negative equity) and may fold shortly , it is roumoured that a vat man is looking for him , and seems to be unable to report to companies house https://beta.companieshouse.gov.uk/company/08220056

    if he instigated court , it would be the first time in that side of the table

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have omitted clear information about the process for complaints including a geographical address of the landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.
