    Thanks everyone for all the advice so far. Auto sec appear to have ignored the Blue letter sent with proof of postage in November.
    The debt Collectors (TNC) have now sent me a letter a letter threatening to issue a Court summons etc.
    No mention of appeals. I am ignoring it.
    Would appreciate your reassurance/or otherwise.

    Are Autosec in the BPA AOS?

    If so, complain to the BPA that an appeal sent by the keeper to Autosec (you kept proof) after receiving a NTK from TNC, has been ignored. Really insist that they deal with this breach and copy in the DVLA to force the BPA not to fob you off:

    Autosec windscreen ticket says BPA member & Approved BPA Operator.
    I will do as you suggest and let you know the resposes...if any!
  • Exactly same here, autosec PCN followed by TNC, NTK, dated 67 days after PCN. Have just (This Monday) sent appeal using blue Template following advice off here. Will not hold my breath while waiting for reply from Autosec.

    Reply to the BPA and ask them to confirm whether they have asked Autosec if they even sent one...if not, why not. As far as you are aware, Autosec have IGNORED an appeal and that is a clear breach of the CoP. Attach your proof of posting.

    Make sure you copy in David Dunford again too.

    AOS replied to my follow up email:

    When a parking operator receives an appeal from a motorist, they will accept or reject the appeal in writing within 35 days of receiving it. You advised in your original email that you did not hear back from the operator after you submitted your appeal. Therefore, you have not received a copy of your appeal outcome letter/email.

    As previously advised, it is not currently a requirement of the Code that the operator send mail recorded delivery, therefore we cannot advise there to be a breach of the Code in this instance.

    As you have stated that you have been receiving further letters from TNC, it appears as though the operator have rejected your appeal, and passed the charge to a debt recovery agent. Once a charge is at the debt recovery stage, the option to appeal is no longer available.

    You will need to contact the operator in order to obtain a copy of your appeal outcome.

    So the BPA seem to be sayingthat Autosec themselves have rejected my Appeal and I have to contact them directly to find out why, because their letter to me has somehow been lost in the post. Really?
    Am I missing something?
