ok , lets look at the code of practice
1: Grace Periods
15.1 Drivers should be allowed a sufficient amount of time to park and read any signs so
they may make an informed decision as to whether or not to remain on the site.
15.2 Drivers should be allowed a sufficient amount of time to leave a site after a pre-paid or
permitted period of parking has expired.
2:Entrance Signs should:
a) Make it clear that the motorist is entering onto private land
b) Refer the motorist to the signs within the car park which display the full terms
and conditions.
c) Identify yourself (where you are a limited company. This should be by
reference to your full company name, your company number and the
jurisdiction within which your company is registered).Save a Rachael

Hi pappa golf,
I was just having a read through the code of practice. The sign which displays the full terms and conditions is not actually in the car park itself, it is placed on a lampost on the pavement just next to the car park entrance which means A driver would have to leave the car park and stand on the pavement to read it, the wording is too small to read from inside a vehicle entering the car park.
Unfortunately it does not state in the IPC what is a "sufficient" amount of time.
I have noticed that in the code of practice it states that a new IPC members are audited to ensure they comply and are given red, amber or green indications in the audit. They are given 6 months to ensure they correct any issues before being given full membership. However Napier have obviously not corrected their signs which should have been audited and they remain incorrect a year after they became IPC members.0 -

Regulars might wish to muse on whether it might be worth an appeal to the IAS based on (contractual) signage showing Napier as being a BPA operator and (contractually) offering POPLA as the second stage appeal. After all, the IPC are on record in saying that all their AOS operators' signage is vetted and approved by them. Could be one of the few evidenced points that the IAS might find difficult to brush aside.
Interested in other regulars' views.
I was musing exactly that too, although the hoops to jump are high (e.g. photos of the signs would no doubt have to be dated to prove when they were taken). Or Skippy & co will say could be old photos.
I don't think the IPC will like seeing signs advertising the BPA and misleading consumers about POPLA, 8 months after Napier moved to the IPC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It will be Napier's usual 3000 word masterpiece, the entrance sign that no-one can possibly read in four minutes even if standing there staring at it. Certainly the terms are wholly illegible from a car upon entering the site.
You can find the terms online by Googling for the word 'Napier' with the name of the car park, there's a website listing them and linking to the wall of words that purports to be an entrance sign.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@OP. Do you have/can you get date and time stamped photos of the signage, including photos that clearly identify the car park your vehicle was parked at?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Take pictures of the signs alongside a current newspaper showing the date and banner headline which of course will now be after the date of the NTK.
