Wonder if I could do the same ?
My elderly parents were double dipped recently but despite me writing to the ppc they have rejected the appeal and are now bombarding my old Dad with threat-o-grams, debt collectors letters, etc. I've told him not to read any more letters from them and just give them to me but if they're addressed to him of course he's bound to open them and take a look. I'll swear he hasn't been the same since this happened.
I've just written another stiff letter to the ppc and I've also filed an online fraud report - whether it'll do any good or not I don't know but perhaps if I lodge a claim they might sit up - here's what I sent....
Dear Sir
I am writing this on behalf of the registered keeper who is an 85 year old disabled blue badge holder with mobility problems.
To reiterate - the facts relating to this fake parking charge are as follows:-
The registered keeper and the driver of the vehicle visited The Range store in St Helens in the morning and purchased a curtain pole, which turned out to be faulty, so they returned later that afternoon to exchange it. That’s two separate visits each of less than half an hour and about four hours apart as confirmed by the previously sent receipts. We have an independent witness ( the person who came to fit the curtain pole and subsequently found it to be faulty) who can place the vehicle and driver at the registered keepers address at lunchtime that day.
Clearly, the evidence we have, (receipts, times and witnesses who will testify) proves that the registered keepers car left the car park in the morning and then returned later that afternoon.
I am well aware of the so called ‘double dipping’ scam that you operate from this car park, having spoken to others with whom you have tried the same tactic, and realise that you know full well that two visits were made that day but choose to deliberately withhold the photographs of the car leaving in the morning and returning in the afternoon in an attempt to fraudulently obtain money from the registered keeper.
I would suggest that you are in breach of the Fraud Act 2006 and it is my intention therefore to file an online fraud report to the National Fraud and Cyber Crime Reporting Centre regarding this matter. I will also be making a complaint to The Range store, the BPA, the DVLA and the media as I feel that it is about time that organisations such as yours who engage in this kind of criminal activity are exposed.
No further correspondence will be entered into

That's a good letter, why not send a copy of it now to the CEO of The Range with a well-written LBCCC attached to it, stating that the victim of this DPA breach wants £750? No need to delay or give them a chance (except using a LBCCC showing them the issue). The Range have NEVER taken complaints about PE seriously, never cancelled one that I can ever recall.
Do some research about setting out a decent LBCCC that reads fairly, not ranty. It MUST be written in your Dad's name from now on with his signature, this is going to be his claim as it's his data (you have no connection and suffered no wrong).
Oh, and in Dad's name, put in a complaint to the ICO now, asking them to investigate (again, NOT in your name as you are not the affected victim). If they find, as they should, that this continued harassment and sharing of data despite them knowing about the double dip is a DPA breach then that becomes fundamental to Dad's claim evidence...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

In all honesty would wooder's letter to PE do any good? Even when presented with irrefutable proof ( such as witness statements and documentation) they still say that they are right and the motorist is wrong.

It is not what they say which matters, it is what a judge says.
With more and more PPCs taking the court route we should be encouraging posters to fight back. A counter claim costs the PPCs £££ and they cannot pull out at the last minute.
We now have two recent cases where the courts have given the PPCsa pasting, let us have more.You never know how far you can go until you go too far.0 -

You're probably right - they don't really seem interested in the truth and having spoken to others who have experienced the same thing I'm guessing that they just send as many of these scams out as possible knowing that a percentage will come back with a cheque enclosed. I was gobsmacked to find that some who had been double dipped had actually just paid up to make it go away !!
Btw it isn't PE who run this particular car park, it's Care Parking and I don't think they do court but I'm pretty sure this isn't going anywhere near a court anyway.0 -

I hope I remember correctly but I remember reading that the program they use was for checking that staff actually stayed for the correct time at a business, unless it has been modified (I doubt) then its not a flaw and they know exactly how it should work. They rely on people just giving up.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

I'd suggest the retail park managing agents are the guilty party and you can usually find them by Googling the name of the retail park and going back 2 or 3 pages in your results to find newspaper articles or advertising blurb. Do not threaten to sue, or sue, the wrong party, hence why I suggested a letter of complaint first as a fishing exercise in my much earlier post, to get out of them an admission, as they brush your Dad off, that they do have this contract. Then your Dad responds with a LBCCC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

According to the manager of the Range, who I initially contacted about this pcn, the car park is owned by Tesco - anyways, I'll have a dig around , see what I can find...

If i remember correctly there was an issue with Tesco owned car parks being infested by PPCs that were not appointed by Tesco, and it could possibly have involved the RangeFrom the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0
