as above, get the RK to complain to TESCO as they may not be aware of this sub-contract0

If i remember correctly there was an issue with Tesco owned car parks being infested by PPCs that were not appointed by Tesco, and it could possibly have involved the Range
I remember that too, a particular commercial property/holdings arm of Tesco.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was B&M stores who appointed them and were swiftly told by Tesco to get shot. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi All,
Found this thread via the one with the DVLA complaint letter in it.
In short :
- I got a double dip ANPR ticket in Scotland.
- I called the store (McDonalds), They got it cancelled. I had no contact with the parking firm UKPC.
- What should I do (if anything) to try and get back at them?
Cheers0 -

Forget it, get on with your life.
Or you could avidly read all these threads that crop up and learn the advice given. Then you could gradually start giving advice until you become a knowledgable regular which will then have an impact on the likes of UKPC and others that inhabit this pond. .
Or are you thinking of something more instant - like taking a contract out! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You could tell everyone you know how to beat tickets. You could cost them a fortune if you helped out.0

I asked because the post I mentioned seemed to suggest that complaining to the DVLA, getting confirmation that DPA was breached and then going after the companies in the small claims court was a valid route of recourse against them. Obviously not then.0

It can be a valid course of action but it is a lot more difficult than it sounds. In your case you give no grounds to suggest the DPA has been breached so it really wouldn't be wise to advise you to go wasting money on court cases that are doomed to fail.
On the other hand helping fight tickets is something anyone can do and still causes them severe grief.0 -
It is very early days in terms of DPA breach claims being made against private parking companies. Not one case in its own right has yet gone to court, although there is work going on off forums to trailblaze some cases.
The cases will be pursued in England and Wales and this is where some persuasive outcomes might be possible. Scotland is a different kettle of fish in terms of 'small claims' and I can't see any of the forums dissipating effort away from E/W at this stage.
What I'm saying is you'll be on your own and have to do all the Scotland-related research for prosecuting such a case, then take it through the necessary legal stages up there, which as I understand it, are much different than down here.
Unless you're legally trained/qualified or keenly follow and are au fait with Scotland legal procedures, then this is not something to pursue - at the moment. I say 'at the moment', because you have 5 years to pursue in Scotland (6 years in E/W), so you have time to wait and see how things start to pan out. Please note, we are not a legal advice forum.
