I see tonight on parking prankster that a "customer" of smart parking took them to the small claims court for falsly issuing a ticket (bad ANPR system) , needs to be done more often , in fact EVERY time a person is falsly accused , use the backing of POPLa as proof of their failure ,

The guy with the NCP PCN who did two three point turns, should pop a claim in for £750 as per the case of Halliday v Creation Consumer Finance Ltd [2013] All ER (D) 199

People should do this much more. We must encourage this as well as complaints to Mrs May, although with this sort of thing you have to pick the cases where the PPC should NEVER have got the data (where PPCs issue double-dip PCNs, certainly!). Not all cases, but plenty of them, could lend themselves to this sort of claim, along with cases where the charge was 'sold' to MIL, contrary to the KADOE contract with the DVLA (claim against the PPC not MIL).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I know of a couple of ambulance chasing solicitor's , will advise them to check the courts daily
would it not be good if LPC law were roped into to help on a daily basis ,

I agree. In fact I think that we should encourage people to take things further.
How many times do you read of motorists winning in court and being awarded a paltry £95 when clearly the PPC or their solicitor has acted unreasonably.
Why are CC judges so reluctant to sanction PPCs who harass occupants of flats for failing to display their permits when their lease/TA makes no requirement, in cases of double dipping, when papers are served out of time, when they have failed to comply with ATA COPs., when they make false statements, and much more?,
Is it that most people are so in awe of a judge, usually an ex solicitor, on the bottom rung if the judicial ladder, that they do not question him or her. Many PPCs set them selves up for a kicking, why do so few get one?You never know how far you can go until you go too far.0 -
can this apply to any JLA airport cases or indeed indigo (railway) after the requisite 6 mth has passed?Save a Rachael

It would be interesting to know if the increasing amount of PPC's that can't be arsed to contest a POPLA appeal could be held to have falsely issued a ticket?'People are stupid; they can only rarely tell the difference between a lie and the truth, and yet they are confident they can, and so are all the easier to fool.' Yes why not, you just need to show misuse of data (read the DPA principles and see what they breached). Not possible in all PCN cases at all but yes, certain ones.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

could cause B+W problems if this was done in bulk
oh , I,m feeling horrible tonight , + the DVLA and the BPA + IPC would have to sanction companies that have been proved to be acting illegally ,Save a Rachael

I vaguely remember that during the bad old days of clamping, when people turned on the clampits, and the going got tough the clampers just shut up shop and pheonixed into another clamping company.
Much as there is disgust at the antics of the parking companies and their associates, other than the DVLA the finger of blame, and any target for revenge should lie firmly at those who permit the PPCs to operate.
Farmers as either landowners or tenants/landholders can not allow dangerous animals loose on private land where the public have access, why should large retailers with fluffy social media and glossy PR departments be any different?
There are plenty of cases on here where the supermarkets and other corporate entities from pub chains to property management companies imposing ppcs on residents to retailers, motorway service areas and so on have shirked their responsibilitys as principal.
PPCs do what they do, the evidence is here, in this forum and elsewhere, PPCS are nothing but the dumb beasts of the urban/suburban and out of tow retail parks, theres plenty of evidence out there about what happens.
Its about time the fight was bought to those who allow the PPCs to operate, and the PPCs should be bypassed in any fight for revenge.
to the best of my knowledge there was no car park Armageddon when ASDA got rid of Smart, so why did they get in bed with that lot from Chorley?
Likewise car parks and out of town retail parks existed long before the PPCs came onto the scene like a swarm of parasites.
Without the support and backing of the landowners PPCs will simply be unable to operateFrom the Plain Language Commission:

Good point Half_way.
So if a double dip or other truly vexatious PCN occurs, then one idea could be to sue whoever the parking firm contracted with, after checking carefully first to see that you've got the right party. Perhaps by first sending a vague 'complaint' about the PPC as a fishing exercise...then if the retailer or managing agent admits they contracted with the scumbags, a LBCCC can be served demanding £750 or court will follow, because they are liable for the actions of their agents.
Then a claim, if the above has not evoked panic mode and a payment.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

but ,, but ,, they would sack thec PPC and there would be carmagedden!
actually its time that ANPR was questioned more closly and a stipulation made that the PPCs had to use foot soldiers AND place the ticket on the car , note the ways the counsils are dropping ANPR
closely followed by the removal of the BPA and IPC , and a truly INDOIPENDENT AOS set up , one with no financial gain (PPC yearly membership and xmas *iss up)Save a Rachael
